Retd. Justice M. Sathyanarayanan of the Madras High Court to go into the loopholes, lacunae and grievances of the public and stakeholders against the three new Criminal Laws- (The Bhartiya Nagarik Suraksha Sanhita, 2023, the Bhartiya Nyaya Sanhita, 2023 , and the Bharatiya Sakshya Adhiniyam, 2023) introduced by the BJP Government including the validity of the title of the 3 Acts and give suggestions on amending them using the State’s legislative powers.

The new 3 laws which replaced the existing Indian Penal Code, Criminal Procedure Code and Indian Evidence Act have created chaos and havoc in the criminal justice system as they have been introduced abruptly, without taking into consideration the views of the stakeholders like Judges, advocates and police. That apart, the introduction of these 3 laws (including many cut copy paste provisions from old laws) seem to be with the sole intention of having Sanskrit titled legislation as it is not progressive. The laws have neither considered nor provided for incorporation of technology and advancements in forensics in criminal investigation and trial.

I request the members of the public, ld. advocates, jurists and all stakeholders to communicate your views to the one man committee once the committee takes charge so that the committee can prepare a comprehensive report for the consideration of the TN Government.

It is to be noted that Tamil Nadu is the first State to constitute such a Committee. I hope all States will follow this example to save our Constitution and criminal justice system!
