Mr P. Wilson , Mr ARL Sundaresan, Mrs Hema Sampath argued for Appellants( Thenkalai sect). For Respondents ( Vadakalai sect) Mr G Rajagopal , Satish Parasaran and V Ragavachari argued.

The operative portion of the order passed by division Bench today reads thus:-

*As agreed by both the parties in order to give quietus to the issues involved herein, all the connected matters are directed to be posted after summer vacation along with present writ appeals after obtaining orders from hon’ble cj . Till such time notice dt 14.05.2022 issued by ac/executive trustee of a/m devarajaswamy temple thirukoil kanchi and the order of the learner judge dated 17.05.2022 in wmp 12434 of 2022 in wp 12955 of 2022 shall be kept in abeyance*

Thus the 17.5.2022 Hon’ble Justice SM Subramaniam order allowing chanting of mantras by Vadakalai Sect during daily services offered by Thenkalai Sect stands suspended.

The EO in his order dated 14.5.22 which was impugned in the Writ Petition by Vadakalai Sect has directed to abide by 1915 HC decree failing which any person disobeying the court decree will be removed and further entry will be denied.
In the writ petition the Vadakalai sect challenged 14.5.2022 order stating that they will be prevented from chanting Desika dayapatrams.

It was argued by P. Wilson on behalf of Thenkalai sect that since more than 300 years the office of mirasidar adhyapaka rights to recite Srisailapatram (Prabhanthams ) by Thengalai sect before deity (from commencing of Pooja till completing with ringing of bells and offering of prasadhams) is existing. Once the services of Thenkalai sect is completed , the Vadakalai’s sects were permitted to Chant their Desika Daya Pathiram.

When disputes erupted over this, the Thenkalai Sects approached courts and A decree was granted by HC in the year 1915 and same was confirmed by refusing to grant certificate to privy council by the High court in the year 1915 itself.

The HC ordered that Thenkalai sects alone can recite Sri sailesa daya patram in the beginning and end of the daily services. Vadakalai can recite the same hymns that Thenkalai recite.
Vadakalai can recite the same Prabandhams jointly with Thenkalai without separate goshti from the third row.
Vadakalai sect cannot recite their Desikar Dayapatram during this service and court restrained them from doing so.

Once again another suit was initiated by a Vadakalai Sect which reached HC and same was dismissed by HC in the year 1969.

Thus the Thenkalai were having preferential exclusive rights to can’t mantras before the Kanchipuram temple even till today which Vadakalai sects are opposing
