This Original Petition has been filed seeking a direction to the respondent to register the complaint given by the petitioner dated 15.07.2021, which was received in CSR No. Not Known of 2021 on the file of the respondent.
2. Earlier, when the matter came up for hearing, it was submitted by the learned Government Advocate (Criminal Side) that the matter has been pending before the Commissioner, Vigilance and Anti-Corruption, Chennai, for approval under Section 17-A(1) of the Prevention of Corruption Act, 1988 and therefore, this court had, by order dated 15.11.2021, directed the Commissioner to pass suitable orders within a period of two months from the date of receipt of a copy of the order.
3. Today, when the matter has been taken up for hearing Ms.C.Jeyapriya, Inspector of Police, Vigilance and Anti-Corruption, Theni Detachment, who was present in court, submitted that since the officials from two different departments of the State were involved in the crime, under Section 17-A(1) of the Act, the investigating officer has to get previous approval from the District Collector in respect of the officials belonging to Revenue Department and from the
Additional Chief Secretary, Government of Tamil Nadu, Department of
Industries in respect of the officials belonging to Department of Geology and Mining before proceeding in the matter. According to her, the District Collector concerned has already given approval for proceeding against the officials belonging to the revenue department who were involved in the crime and in so far as the approval in respect of the officials belonging to the Department of Geology and Mining is concerned, the matter is pending with Additional Chief
Secretary concerned for approval and as soon as the approval is given by the Additional Chief Secretary, the respondent would take further action in the matter in accordance with law.
4. Considering the fact that the matter has been pending from July 2021 and as already the District Collector has given approval under Section 17-A(1) of the Prevention of Corruption Act, 1988, for proceeding against the officials belonging to the revenue department, the Additional Chief Secretary, Government of Tamil Nadu, Department of Industries, is directed to consider the request made by the respondent seeking previous approval for proceeding against the officials belonging to the Department of Mining and pass orders in accordance with law. The above said exercise shall be completed by the
Additional Chief Secretary on or before 03.02.2022.
The Registry is directed to list the matter on 04.02.2022.
