Mr.R.Rajesh, learned counsel appearing for the petitioner submitted that the petitioner’s father purchased a land in S.No.294-13B situated at Thanikkottam Village, Vedharanyam Taluk, Nagapattinam District, measuring to an extent of 0.075 Acres vide Doc.No.430 of 2002 dated 17.04.2002 on the file of Thakattur Sub-Registrar Office and the Joint Patta No.1274 stands in the name of his father along with adjacent land owners. While so, the petitioner’s father made an unregistered Will in favour of the petitioner on 07.01.2016. That being the case, the petitioner made an online application dated 23.09.2022 for transfer of patta in favour of the petitioner to the 3rd respondent, through unregistered document and the said application was rejected on 13.10.2022 on the ground that the petitioner had not produced any valid title to substantiate his claim for grant of patta.
2.The learned counsel appearing for the petitioner further submitted that as per the Section 18 of the Registration Act, 1908, a Will need not be registered and its only an optional. Therefore, prayed for issuance of patta.
3.Mr.U.Bharanidharan, learned Additional Government Pleader appearing for the respondents submitted that the patta will be rectified and granted on considering the application of the petitioner, if it is otherwise in order, on or before 30.11.2022.

*பதிவு செய்யப்படாத உயில் ஆவணத்திற்கு பட்டா வழங்க மறுக்க வட்டாச்சியருக்கு அதிகாரம் இல்லை.*
வேதாரண்யம் வட்டம் தாணிக்கோட்டகம் கிராமத்தை சேர்ந்த *திரு. எஸ்.ஆர். பாரதி* சென்னை உயர் நீதிமன்றத்தில் தாக்கல் செய்த மனுவில் கடந்த 2016-ஆம் ஆண்டு எனது அவரது தந்தை எழுதிவைத்த பதிவு செய்யப்படாத உயில் ஆவணத்தை கொண்டு பட்டா மாற்றம் செய்ய விண்ணப்பம் செய்யப்பட்ட நிலையில் உயில் ஆவணம் பதிவு செய்யப்படவில்லை என்ற காரணத்தால் பட்டா வழங்க முடியாது என்று கூறி வேதாரண்யம் வருவாய் வட்டாச்சியர் விண்ணப்பத்தை நிராகரிந்துவிட்டர். வட்டாச்சியர் பிறப்பித்த உத்தரவிற்கு எதிராக சென்னை உயர் நீதிமன்றத்தில் தாக்கல் செய்த மனு நேற்று விசாரணைக்கு வந்தது அதில் மனுதாரர் தரப்பில் பத்திர பதிவு சட்டம் 1907 பிரிவு 18 ன் படி உயில் ஆவணம் பதிவு செய்ய வேண்டும் என்பது கட்டாயமில்லை பதிவிற்கு விளக்கு அளிக்கப்பட்ட ஆவணம் என்று சட்டம் கூறுகிறது ஆனால் வட்டாச்சியர் ஆனால் உயில் ஆவணம் பதிவு செய்யப்படவில்லை என்றும் பட்டா வழங்க சட்டத்தில் இடமில்லை என்றும், கீழமை நீதிமன்றத்தில் உயிலை நிரூபணம் செய்ய வேண்டும் என்றும், பதிவு செய்யப்படாத உயில் செல்லாது என்று கூறுவதற்கு வட்டாச்சியருக்கு அதிகாரம் இல்லை என்றும் வாதிட்டனர் இரு தரப்பு வாதங்களையும் கேட்ட நீதிபதி
உயில் ஆவணம் பதிவு செய்ய வேண்டும் என்பது கட்டாயமில்லை எனறு கூறி வட்டாச்சியர் பிறப்பித்த உத்தரவை ரத்து செய்து பட்டா வழங்க உத்தரவு பிறபித்தார்.
