Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to issue a Writ of Mandamus directing the 2nd respondent i.e., the District Collector, Madurai to reduce the punishment of increment stoppage awarded in the District Collector, Madurai’s proceedings in Na.Ka.No.12234/2012 dated 11.03.2013 from three years to three months in respect of the the petitioner also as was done by this Hon’ble Court in the case of Thiru.M.Adhimoolam in W.P.(MD) No.10106 of 2014 dated 18.11.2021 within a specified time frame that may be fixed by this Honourable Court.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.VISVALINGAM, Advocate for the petitioner and of Mr.A.KANNAN, Additional Governmnet Pleader on behalf of the Respondents, the court made the following order:-
This writ petition is filed by one Mr.S.Kumaravel, who is working as an Assistant in the Office of the Panchayat Union, Alanganallur, Vadipatti Taluk, Madurai District, for a mandamus directing the second respondent, the District Collector, Madurai District to reduce the punishment of increment stoppage awarded by him in proceedings in Na.Ka.No.12234/2012 dated 11.03.2013 as provided in WP(MD)No.10106/2014 dated 18.11.2021.
2. This writ petition is listed for admission today and takenup for hearing around 11.30 am. At that time, Mr.A.Kannan, the learned Additional Government Pleader submitted before this Court that this petitioner Mr.S.Kumaravel has approached his junior one Ms.M.Srimathi, posing himself as an officer came to the Government Pleader Office for providing instructions to the Government Pleader in this Writ Petition. The petitioner has informed the Government Pleader’s junior one Mr.M.Srinivasa Raghavan that he is the petitioner in this case and he is prepared to offer any amount to the Government Pleader, if he does favour to him. He further requested the Government Pleader’s junior to provide the address of the Government Pleader.

On knowing this incident, Mr.A.Kannan, learned AdditionalGovernment Pleader has called the learned counsel for the petitioner today ie., on 21.12.2021, around 08.40 am, and informed that his client Mr.S.Kumaravel has attempted to bribe him through his junior. The learned Additional Government Pleader would submit that even after that, the petitioner Mr.S.Kumaravel from his mobile number 9442028912 called the Government Pleader’s junior Mr.Srinivasa Raghavan around 09.40 am in his mobile number 8248664733 and reiterated the same offer that he is prepared to pay any amount as required by the Government Pleader. The learned Additional Government Pleader expressed his anguish in the morning that this is how he was treated in this case and he has also brought to the notice of this Court what had taken place on yesterday and today. This Court directed the Government Pleader to file a memo to that effect.
4. The learned Additional Government Pleader also filed a memobefore this Court and paragraph no.3 of the memo reads as follows.
“I humbly submit that, the writ petitioner
Mr.S.Kumaravel on 20.12.2021 at about 06.30 pm parged into the G.P. Office and met my Junior Selvi M.Srimathi and posed himself as an officer who came for giving instructions to the Writ Petition which is coming for admission on 21.12.2021. After a while my another Junior M.Srinivasa Raghavan came to my table and enquired about Mr.S.Kumaravel.”

It is unfortunate that corruption has reached this extentand the petitioner who is already facing punishment, had entered into the Government Pleader Office, managed to get details as to whom this case has been allotted, managed to collect the details of the juniors of the concerned Government Pleader and has also approached the junior of the Government Pleader in such a bold manner that he is ready to offer anything, if the Government Pleader does favour to him.

It appears that the petitioner Mr.S.Kumaravel approached theGovernment Pleader as if he came to the Government Pleader Office to give instructions on behalf of the respondents in the petition, though he is the petitioner in the writ petition. Such an act of the petitioner has to be deprecated and dealt with in an appropriate manner. Hence, this Court is incline to refer the matter to the Vigilance and Anti Corruption Department. The Deputy Superintendent of Police, Vigilance and Anti Corruption, Madurai is directed to conduct enquiry with regard to the memo dated 21.12.2021, filed by Mr.A.Kannan, learned Additional Government Pleader, collect the call details, tower location, CCTV footage if any and all the other relevant materials, enquire the learned Additional Government Pleader, his juniors, the petitioner and the learned counsel appearing for the petitioner and file a report before this Court on 19.01.2021.
7. This Court places its appreciation to Mr.A.Kannan, learnedAdditional Government Pleader for bringing this incident to the knowledge of this Court and also filing a memo before this Court. This must be the conduct of every Government Servant whenever a person is attempting to bribe them. sd/-
