When the Contempt Petition came up for hearing on 03.03.2023, after statutory notice was ordered, the second respondent did not appear before this Court, citing the reason that he had a meeting with the Government officials. Though this Court was not in appreciation of the reason given by him in the last hearing, an opportunity was given to him by directing him to appear before this Court today.

Today, when the matter was called, the second respondent has filed an application seeking for dispensing with his appearance, accompanied with an affidavit dated 14.03.2023, in which, he has stated that since the Hon’ble Minister for School Education is inaugurating the Martial Arts Training Program at Jolarpettai, Tirupattur District, his presence as Commissioner of School Education in the function is inevitable.
3.The learned Additional Advocate General attempted to impress upon this Court, by offering to require the presence of the second respondent before this Court in the next week and further submitted that, it was not the deliberate intention of the second respondent to disobey such orders.
4.I am not in agreement with such submissions made. The manner in which the second respondent has assigned reasons for not appearing before this Court on 03.03.2023, as well as today, are not appreciable and shows the scant respect he has extended to the orders of the Madras High Court and the importance he has chosen to give for attending meetings with the Government officials and for accompanying the Hon’ble Minister, instead of complying with the statutory notice of this Court.
5. In this background, a bailable warrant is hereby issued to secure the presence of the second respondent herein/The Commissioner, School Education Department, Chennai-600 006, before this Court on 24.03.2023.
6. Registry is directed to issue a copy of this order to the Commissioner of Police, Chennai, for effective implementation of the order.
7. Post the matter on 24.03.2023.
