    Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to remove all the “No Parking Sign Board, Mud bags, No Parking Barricades” unauthorized and illegally put by the residents of the city of Chennai within the time frame fixed by this Court and also direct the respondents to give proper publications through print and visual media to the public for removal such “No Parking Sign Boards, Mud bags, No Parking Barricades”.

    ORDER
    (Order of the Court was made by the Hon’ble Acting Chief Justice)
    This writ petition is filed by the petitioner for issuance of a writ of mandamus directing the respondents to remove all the No Parking Sign Boards, Mud bags, No Parking Barricades unauthorizedly and
    illegally put up by the residents of the Chennai City and also to direct the respondents to give proper publications through print and visual media to the public for removal such No Parking Sign Boards, Mud
    bags, No Parking Barricades.

The grievance of the petitioner is that in most of the roads in Chennai City, the owners of the multi-storied buildings, apartments and individual bungalows are misusing the public space by putting up no parking sign boards, mud bags, no parking barricades, and are thereby not allowing the public to park their vehicles in the roads. This menace has cropped up mostly in Adyar, T.Nagar, Mylapore,
    Madaveli, Mambalam and Ashok Nagar and in suburbs of Chennai City. He alleges that such boards are being put up by the owners in
    connivance with the respondents.
  5. Today, when the writ petition is taken up for hearing, learned Additional Public Prosecutor, on instructions, submitted that action has been taken to remove all no parking sign boards, mud bags and no parking barricades put up unauthorisedly and illegally in the public places specifically mentioned by the petitioner in the writ petition. In
    support, learned Additional Public Prosecutor has produced the
    photographs.
  6. The said statement of learned Additional Public Prosecutor is not disputed by learned counsel for the petitioner. However, learned counsel for the petitioner submitted that proper publication should be effected accentuating that the owners of the multi-storied buildings, apartments and individual bungalows should not indulge in misusing the public space by putting up no parking sign boards, mud bags, no parking barricades. In this regard, the authorities should lay down guidelines and/or issue directions either on the official website or by way of publication in print and visual media. The authorities should also take stern action against the persons who are indulging in such
    unlawful activities.
  7. In reply, learned Additional Public Prosecutor assures this Court that necessary instructions will be issued by the Commissioner of Police, Greater Chennai, to the officials concerned for hosting necessary guidelines and/or directions in the official website within two weeks from the date of receipt of a copy of this order, besides publishing it in the print and visual media. The authorities should also
    indicate therein the penal consequences to be taken against the individuals who indulge in occupying public places without any authority whatsoever.
  8. Recording the aforesaid submissions, the writ petition stands
    disposed of. There shall be no order as to costs.
