Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the order passed by the second respondent bearing Seyalmurai Aanai No.07/H4/KAA.NI/2022, dated 11.08.2022 and to quash the same as illegal and consequently direct the respondents to grant permission to conduct protest with microphone by giving petition to buffalo pursuant to petitioner’s representation dated 06.08.2022 and 11.08.2022.

O R D E R

Challenging the order passed by the second respondent dated 11.08.2022 and seeking permission to conduct protest with microphone by giving petition to buffalo pursuant to petitioner’s representation dated 06.08.2022 and 11.08.2022, this writ petition has been filed.

  1. At the outset, this Court is of the view that to make such democratic protest, animals need not be subjected to cruelty. Therefore, the prayer as sought for by the petitioner to take buffalo or any other animal and keep them from morning to evening cannot be permitted. Such act itself would amount to cruelty of the animals and violation of the Prevention of Cruelty to Animals Act, 1960.
  2. Such view of the matter, the prayer as sought for by the petitioner is negatived, however, at this stage, the learned counsel appearing for the petitioner submitted that they may be permitted to conduct democratic protest without any animal being taken there.
  3. Accordingly, the respondent police is directed to consider the representation of the petitioner and grant permission in the place earmarked by the police with all usual conditions. The writ petition is disposed of accordingly.  No costs.
