Report about the case relating to teacher of PSBB School

The All Women Police Station (W26) filed charge sheet alleging that the accused G.Rajagopal, who was working as a teacher in PSBB School, Ashok Nagar, has committed an offence as defined under Section 11(i)(ii)(iii)(iv) r/w. Section 12 of POCSO Act along with 354(A), 509 IPC and 67, 67(A) of IT Act and the case has been taken as Spl.SC.No.139 of 2021 before the Special Court.

2.In the said Sessions Case, Crl.MP.No.1411 of 2021 has been filed by the accused under Section 218 of Cr.P.C., seeking to split up the case in respect of  each alleged victim, since according to the Petitioner/Accused, five out of eight counts in respect of Section 12 alleged to have been committed by him are time barred, since those complaints have been filed after five years, whereas the maximum punishment prescribed for the said offence under Section 12 is only three years.  So, in order to make out effective defense, he prayed for splitting up of the above said Special Sessions Case into eight single case.

3.Learned Government Advocate would contend that the case is not covered under Section 218 of Cr.P.C., however, it could fall under the proviso thereto and hence, Section 223 of Cr.P.C., is to be applied and further contended that all the alleged occurrences are arising out of same transaction as mentioned in Sections 235 and 239 of Cr.P.C.

4.In the above said Revision, when the matter is came up before the Hon’ble Mr.Justice RMT.TEEKAA RAMAN, his Lordship has passed the following order:

“Learned Counsel for the Petitioner is required to file the summary of allegations made by the victims against the Petitioner in a tabular column along with duration.

For filing counter affidavit of the Respondent, call the matter on 11.08.2022.  In view of the submissions made above, the learned Sessions Judge, Special Court for exclusive trial of cases under POCSO Act, Chennai is required not to record evidence in Spl. SC. No.139 of 2021, till the next date of hearing viz., 11.08.2022.”
