Pursuant to the order dated 10.01.2023 passed by this Court, the second respondent/sub-tenant is present before this Court.

  1. The second respondent/sub-tenant states that partially he has cleared the goods from the subject premises and he needs further time to vacate the premises completely and to pay the arrears of rent to the revision petitioner/landlord.
  2. This Court is not inclined to grant any further time in view of the fact that the second respondent/sub-tenant not only has given undertaking before this Court now, during earlier occasions also, he had given undertaking both before this Court and the Apex Court that he will vacate the subject premises and handover vacant possession to the revision petitioner/landlord. The second respondent/sub-tenant has no respect towards the Court proceedings and even after giving undertaking after undertaking he has failed to vacate the premises. The disrespect shown by the second respondent/sub-tenant towards the Court’s orders is not acceptable and therefore, this Court has no option but to direct the office of the Public Prosecutor to initiate steps through the jurisdictional police and ensure that the subject premises is vacated, through the police with the assistance of the Court bailiff and handover the vacant possession to the revision petitioner/landlord within 48 hours from the date of receipt of a copy of this order.
  3. It is made clear that the jurisdictional police may bring the Court bailiff also at the time of evicting the premises and handing over the same to the revision petitioner/landlord.
  4. In respect of rental arrears, the second respondent/sub-tenant is directed to pay the rental arrears of Rs.3,45,000/- [Rupees Three Lakhs and Forty Five Thousand only] as on December’2022 to the revision petitioner/landlord within a period of four weeks from the date of receipt of a copy of this order as per the decree passed in HRCOP No.11 of 2016 dated 13.06.2017.
