In our previous order dated 25.08.2023, we had clearly held that the order has to be complied with in letter and spirit, as otherwise, they have to cast their appearance before this Court on the next date of hearing. Moreover, a Statutory Notice was also issued to the respondents as early as on 06.04.2023. Though the presence of the respondents / contemnors had been dispensed with on 01.06.2023, it does not mean that this Court has given license to disobey the order of this Court. The respondents, namely, Mrs.Swarna I.A.S., and Mrs.Mythili K.Rajendran I.A.S. have neither chosen to comply with the order of this Court nor to appear before this Court and the act of the respondents is highly deprecated, thereby making a mockery of the Court and the judicial system. Hence, we are inclined to issue a Bailable Warrant to the respondents to secure their presence. This Contempt Petition has been filed to punish the Respondents for wilful and deliberate disobedience of the judgment passed by this Court dated 23.12.2020 in W.A.No.2537 of 2019.
- This Court had passed an interim order on 25.08.2023, in which in
Paragraph No.3, it was observed as follows:
“3. We make it very clear that in case, on the next date of hearing, if the order of this Court is not complied with, then the respondents will have to appear before this Court.”
- When this Court posed a question to Mr.S.John J.Raja Singh, learned Additional Government Pleader as to whether the order of this Court has been complied with, on instructions, he has stated across the bar that the respondents are in the process of complying with the order of this Court and sought further time.
