[02/10, 20:59] sekarreporter1: Samsung India Thozilalar Sangam preferred a Writ Petition seeking direction against the Registrar of Trade Union and Deputy Commissioner of Labour to take immediate action on their application to register the trade union name “Samsung India Thozilalar Sangam” as per the provisions of the Trade Union Act, 1926. Mr. N.G.R. Prasad, Senior Counsel appeared for Petitioner Counsel Mr. S. Sivakumar, stated that the Trade union shall register their trade union name based on their representation. The Additional Advocate General Mr J. Ravindran appearing for the 1st Respondent stated that there has been an objection in registering said Union name with the trademark of the Samsung Compay stating that their name should not be used for the Thozhilalar Sangam and hence the application is kept pending. Mr. G. Rajagopalan, Senior Advocate appearing for M/s. G.R. Associates submitted that M/s. Samsung India Electronics Pvt Limited had objected to the same and filed an impleading petition to include them as a Respondent, as it is a necessary party to the said writ petition. The Hon’ble High Court observed that it is for the 3rd Respondent to take a call and appreciate the reasonableness and concerns of Management in registering the Trade Union. As Mrs. M. Jayanthy, Learned Additional Government Pleader took notice for the 1st Respondent, and Notice was ordered to Respondent 2 and 3 returnable by two weeks while permitting private notice as well and directed the matter to be listed after two weeks.
