  • [1/8, 22:33] Sivaji: 8-1-21 mahaveer shivaji MHC advocate: The power of interpretation of judiciary is confined when there exists a ambiguity in laws enacted by parliament with reference to the constitution and also to constitution when it requires the innermost meaning of constitution with its aims, aspirations, ideals and goals with reference to preamble., Which is the essence of constitution.. that is why the judiciary is empowered to declare a law as null and void even it is passed by fullest members of parliament (545+250) and also consented by President of India. which means a single judge of court of law (high court and supreme court) can overthrow the parliamentary decision with intention to uphold supremacy of the constitution that doesn’t mean that the law courts are supreme and it can’t over ride the constitution because constitution alone is supreme, which indicates the very fundamental principle of rule of Law and the constitution itself is acting as limitations on judiciary, which only a gaurdian not be the owner of it.further the innermost principles within judiciary, the advocates’ are kept independent from court and judges only for the purpose to establish boldly a laws, which on the concept of independent judiciary not only from Executives and legislatures but also within judiciary. but practically for past one decade the role of advocates’within judiciary is detoriated and made them as servants of courts for the reasons known to all.once advocates speak laws in strict sense then those are looked as trouble shooters this makes lots of repercussions and total failure of equity and faith between Bar and Bench which often put the executive including politicians to stand against the decision of courts and inturn the judiciary is easily influenced by other wings of governance which directly and indirectly undermining the constitutional supremacy……… thanks…. follows
