In the light of the above, we set aside the impugned order passed under Section 6 of the Act of 1905 with a further observation that it would be open to the State Government or any of the authorities/respondents having right, title and interest over the subject writ property to take appropriate proceedings, as may be permissible under law. Neelakandan, representing the writ petitioner Chief Justice Amreshwar Pratap Sahi and Justice Senthilkumar Ramamoorthy of the Madras High Court on Tuesday decided to hear on November 10, a writ petition filed by DMK president M.K. Stalin in 2017, challenging the passing of a vote of confidence moved by Chief Minister Edappadi K. Palaniswami in the Legislative Assembly on February 18, 2017.
