The Bar Council of Tamilnadu and Puducherry had sent representations to Government with regard to the implementation of the new acts namely Bhartiya Nyaya Sanhita, 2023, The Bhartiya Nagarik Suraksha Sanhita, 2023 and The Bhartiya Sakshya Adhiniyam, 2023 which repeals the Indian Penal Code 1860, The Criminal Procedure Code, 1973 and the Indian Evidence Act 1872 and the Bar Council vide R.O.C. No. 756/2020, R.O.C. No. 982/2020 and R.O.C. No. 1257/2020 dated 16.03.2020, 08.07.2020 and 07.09.2020 respectively, submitting our strong objections for the implementation of new laws.

Recently, the Bar Council of Tamilnadu and Puducherry has also sent a detailed representation to the Hon’ble Parliamentary Standing Committee vide R.O.C. No. 1663 of 2023 dated 01.09.2023, enumerating the difficulties and impracticalities due to the implementation of new laws.

Since the new act has come into force, the Bar Council of Tamilnadu and Puducherry in its General Council meeting held on 05.07.2024 has discussed about the implementation of the new acts and strongly opposed the same and passed a Resolution vide Resolution No. 682/2024, as follows:

To make a request to the Bar Council of India to organize a joint meeting with the Office bearers of all State Bar Councils and Office bearers of all Bar/Advocates Associations throughout the country for the following reasons:

  1. To discuss about the pros and cons of the implementation of the new acts in order to send a representation to the Hon’ble Prime Minister of India, Hon’ble Ministry of Law and Justice, Hon’ble Ministry of Home Affairs and other respective Ministries.
  2. (a) requesting the respective Ministries to take immediate steps to withdraw the implementation of new acts,

(b) requesting to have due deliberation with the major stake holders to participate in the deliberation to submit the valuable suggestions regarding the difficulties being faced by the General Public, Advocates, Law Teachers and Students, Police Officials and other stake holders.

  1. To discuss about the steps to be taken to challenge the implementation of the new acts by approaching the Hon’ble Supreme Court of India. Sd/-xxx CHAIRMAN, BAR COUNCIL.</code></pre></li>
