The batch of Writ Petitions challenging acquisition of certain lands for part of the ECR outer ring road project have been dismissed by the Hon’ble Mr. Justice G.K. Ilanthiraiyan. The cases were filed between the years 2013-15 and interim stay was granted. The petitioners had contended that the TN Highways Act, 2001 had become unconstitutional, that the enquiry process was not as per the provisions of the Act and that entire acquisition is vitiated.
Richardson Wilson, counsel for Government appeared for the State Government and argued that all the issues pertaining to the constitutionality of the TN Highways Act have been settled by the Hon’ble Supreme Court which upheld the validity of the 2019 revalidation Act. He also contended that due process was followed for land acquisition by issuance of notification and enquiry. Accepting the contention of the Government, the Hon’ble Court dismissed the batch of Writ Petitions.
