Interim stay on I-T dept from issuing final order in Benami Act case against DMK MP Kathir Anand

DMK Lok Sabha member Kathir Anand; Madras High Court 

CHENNAI: The Madras High Court imposed an interim stay on the Income Tax Department from issuing final order in the case against DMK Lok Sabha member Kathir Anand under the Prohibition of Benami Property Transactions Act, 1988, but allowed it to continue the adjudication proceedings.

A vacation bench of Justice GR Swaminathan directed Kathir Anand to participate in the adjudication proceedings and file his reply without fail, while hearing the petition moved by the MP seeking a direction to stay the adjudication proceedings and stay the provisional attachment order.

and another DMK functionary Poonjolai Srinivasan approached the vacation bench of the Madras HC seeking to stay the Benami Proceedings before the Adjudicating Authority and stay the Provisional attachment Order made by the Benami Unit for the cash of Rs 11,48,51,500 . The cash pertains to the elections in 2019 when the IT Dept conducted a search and found the cash in a godown .
The Benami Unit attached the cash in Dec 2023 as per the provisions of the Benami Act holding Kathir Anand as the Beneficial Owner and one Poonjolai Srinivasan as the Benamidar and referred the matter to the Adjudicating Authority (PBPT)
Both approached the HC , seeking to stay the notice of the Adjudicating Authority and the further proceedings before the Adjudicating Authority . The HC refused to stay of the Adjudication proceedings or the provisional attachment Order made by the Benami Unit .
The cash of Rs 11, 48,51, 500/- attached by the Benami Unit of the Income Tax Dept, and the reference to the Adjudicating Authority continues. .
The HC has restrained the Adjudicating Authority in passing the final Order. . There is a one year period for passing such Order . Shri Kathir Anand has been directed to participate in the adjudication proceedings and file his reply failing which there will be no restraint in passing the final Order by the Adjudicating Authority .
kathir Anand or his representative has to appear for enquiry and file his reply and participate in the adjudication proceedings before the Adjudicating Authority without fail.
Justice Swaminathan has refused to grant stay of the Adjudication proceedings or the provisional attachment Order.
Sr Counsel Sreecharan appeared for Kathir Anand and Mrs. M.Sheela SPP. IT appeared for the Income Tax ( BPU ) and the Adjudicating Authority .
