Today the appeal filed by Mr. CTR Nirmal Kumar challenging the injunction granted by ld single judge in the defamation suit filed by Hon. Thiru Senthil Balaji was heard by division bench comprising of Hon’ble Mr Justice S.S. Sundar and Hon’ble Mr. Justice K. Rajasekar. The learned single judge had restrained Mr CTR Nirmal Kumar from making defamatory allegations against Mr. Senthil Balaji and had also directed to remove the videos where he had made said defamatory statements. As against this order, Mr. CTR Nirmal Kumar filed his appea. Today when the matter came up before the Hon’ble Division Bench Mr Richardson Wilson appearing for Mr Senthil Balaji contended that the appeal itself was not maintainable since Mr Nirmal Kumar has been set ex parte in the suit since he has not filed his written statement . He further contended that there was nothing incorrect in the order of the ld. Single judge as all the allegations made by Mr. CTR Nirmal Kumar were not backed by evidence. Hence there was a prima facie case made out.

Accepting the arguments, the Hon’ble division bench dismissed the original side appeal filed by Mr. CTR Nirmal Kumar.
