W.P.No.6677 of 2010 and M.P.No.2 of 2010 S.M.SUBRAMANIAM, J. Mr.R.Singaravelan, learned Senior Counsel, consented to assist the Court with reference to the procedures to be followed for confiscation of ill-gotten money or property possessed by the public servants / Government Servants and the public authorities. Large scale allegations of corruption is in the public domain and the actions taken by the Government is insufficient to control the menace of corruption as it is growing day-by-day. Unless the fear of law is visibly shown to the public authorities, it may not be possible to control the menace of corruption in public departments.

Mr.R.Singaravelan, learned Senior Counsel, consented to assist the Court with reference to the procedures to be followed for confiscation of ill-gotten money or property possessed by the public servants / Government Servants and the public authorities.

  1. Large scale allegations of corruption is in the public domain and the actions taken by the Government is insufficient to control the menace of corruption as it is growing day-by-day. Unless the fear of law is visibly shown to the public authorities, it may not be possible to control the menace of corruption in public departments. Thus, a procedure is to be formulated in support of the provisions of law to ensure that the disproportionate assets are confiscated by following the procedures.
  2. In this regard, this Court has to examine the procedures and thus, the learned Senior Counsel Mr.R.Singaravelan, agreed to submit his report and the learned Additional Advocate General appearing on behalf of the respondents 1 to 5 is also requested to submit his report in this regard, enabling this Court to consider the issues.

  1. Today, the respondents 6 to 11 are present before this Court. With reference to the allegation of corruption raised against the respondents, they have stated that it is a false affidavit filed by the petitioner, who amazed wealth by way of illegal means.
  2. Further, appearance of the respondents 6 to 11 are dispensed with. The respective learned counsels are requested to exchange the pleadings in order to avoid further unnecessary adjournments.
  3. Post the matter for further consideration and ‘For passing orders’ on 07.06.2023.
