Full orderநீதிபதி சதீஷ்குமார், தனியார் நிறுவனத்துக்கு நிலத்தை ஒதுக்கி தீர்மானம் நிறைவேற்றாததால், பஞ்சாயத்து தலைவர், துணைத் தலைவரின் அதிகாரங்களை பறித்து இந்த உத்தரவு பிறப்பிக்கப்பட்டுள்ளதாக தெரிகிறது எனக் கூறி, அந்த உத்தரவுக்கு தடை விதித்து உத்தரவிட்டார்.
தனியார் நிறுவனத்துக்கு நிலம் ஒதுக்கி தீர்மானம் நிறைவேற்றாத பஞ்சாயத்து தலைவர் மற்றும் துணைத்தலைவரின் அதிகாரத்தை பறித்து வட்டார வளர்ச்சி அதிகாரி பிறப்பித்த உத்தரவுக்கு தடை விதித்து சென்னை உயர் நீதிமன்றம் உத்தரவிட்டுள்ளது.
காஞ்சிபுரம் மாவட்டம், ஊத்துக்காடு கிராம பஞ்சாயத்து தலைவர் சாவித்திரி, துணைத் தலைவர் வனஜா ஆகியோர் தாக்கல் செய்த மனுவில், தங்கள் கிராம பஞ்சாயத்தில் உள்ள அரசுக்கு சொந்தமான நிலத்தில் 2.34 ஏக்கரை சி.ஜி.டி. ஸ்பேஸ்கோர் என்ற தனியார் நிறுவனத்தின் விரிவாக்கத்துக்கு ஒதுக்கி தீர்மானம் நிறைவேற்றக் கூறி, வாலாஜாபாத் ஊராட்சி ஒன்றிய வட்டார வளர்ச்சி அதிகாரி கடிதம் அனுப்பியதாகக் கூறியுள்ளனர்.
அந்த நிறுவனம் எங்கு அமைந்துள்ளது, அதன் உரிமையாளர் யார் உள்ளிட்ட விவரங்களை வழங்கக் கோரி வட்டார வளர்ச்சி அதிகாரிக்கு மனு அனுப்பிய நிலையில், அந்த விவரங்களை வழங்குவதற்கு பதில், கட்டுமானங்களுக்கு அனுமதி வழங்கும், நிதி விவகாரங்களில் கையெழுத்திடும் அதிகாரங்களை நிறுத்தி வைத்த வட்டார வளர்ச்சி அதிகாரி, அந்த அதிகாரங்களை துணை வட்டார வளர்ச்சி அதிகாரிக்கு வழங்கி உத்தரவிட்டுள்ளதாகக் குறிப்பிட்டுள்ளனர்.
இந்த உத்தரவுக்கு தடை விதிக்க வேண்டும் எனவும், அதை ரத்து செய்யவும் மனுவில் கோரியுள்ளனர்.
இந்த மனுவை விசாரித்த நீதிபதி சதீஷ்குமார், தனியார் நிறுவனத்துக்கு நிலத்தை ஒதுக்கி தீர்மானம் நிறைவேற்றாததால், பஞ்சாயத்து தலைவர், துணைத் தலைவரின் அதிகாரங்களை பறித்து இந்த உத்தரவு பிறப்பிக்கப்பட்டுள்ளதாக தெரிகிறது எனக் கூறி, அந்த உத்தரவுக்கு தடை விதித்து உத்தரவிட்டார்.
மேலும், மனுவுக்கு பதிலளிக்கும்படி, காஞ்சிபுரம் மாவட்ட ஆட்சியர், வருவாய் கோட்டாட்சியர், வாலாஜாபாத் வட்டார வளர்ச்சி அதிகாரி உள்ளிட்டோருக்கு உத்தரவிட்ட நீதிபதி, விசாரணையை ஜனவரி 23ம் தேதிக்கு தள்ளிவைத்தார்.

Learned counsel appearing for the petitioner would submit that
orders have been passed without issuing show cause notice, order also bereft of details. Further when the Panchayat has not agreed to pass resolution for transferring the Anadhinam land, this order came to be passed.
- I have also perused the materials.
- The letter issued by the BDO indicate that they sought transfer of Anadhinam land in S.No.529/6 around 2.34 acres to CGD Space Core Pvt Ltd. As the Panchayat has not passed the resolution as requested by the BDO it appears that consequential orders has been passed.
- In such view of the matter, the petitioners have made a prima
facie case for grant of stay.

- Accordingly, the order suspending the signing powers of the petitioners is stayed until further orders.
