Wilson, Senior Advocate, issued a notice in the SLP filed by RJD rep Manoj Kumar Jha against the Patna High Judgement, which quashed the Bihar Reservations Amendment Act 2023, which granted 65% Reservations for SC, ST, and OBC in the State of Bihar in Employment and education.

Learned senior Counsel Mr P Wilson, appearing for RJD, emphasised that the SC, ST and OBC(BC and EBC) population form 85% in the State of Bihar and pointed out the constitutional bench observation of Hon’ble Supreme Court in the case of Janhit Abhiyan Vs UOI (EWS Reservation) that ceiling of 50% is not sacrosanct and can be breached would be squarely applicable to the present case.
The Amendment Act enhanced the total reservations of SC, ST and OBCs to 65%.
He also emphasised that the Supreme Court has already opened the doors to the other backward class in State-Rendered seats in the case of Neil Aurelio Nunes vs. UOI, and a similar exercise needs to be done for SC, ST, and OBCs in this case in the state of Bihar.

The Bench, comprising of the Hon’ble Chief Justice, Hon’ble Justice Pardiwala, and Hon’ble Justice Manoj Mishra, after hearing the submissions of Mr P. Wilson, Senior Advocate, ordered the issuance of notice to all Respondents in the SLP filed by Rashtriya Janata Dal Party.
