[16/08, 18:09] sekarreporter1: Anticipatory Bail petition filed by one person Murugesan, who forwarded a derogatory Facebook post against Mohd Nabi and Islam, with an intention to create enmity on the grounds of religion dismissed by Hon’ble Madras High Court. Case was registered by Saibaba Police, Coimbatore against one Murugesan and others under sections 192, 196, 299 of BNS Act and section 67 of IT Act. When the matter came up for hearing today before Hon’ble Justice P Dhanabal, Mr. S. Santhosh Government Advocate, Criminal Side, objected to the grant of anticipatory bail, stating that the petitioner with an intention to create religious enmity had forwarded the post against Mohd Nabi and Islam. Deleting the Facebook post will not absolve him of the penal offence, in view of the damage that has already been caused. He also relied on the decisions of the Hon’ble Supreme Court and Hon’ble Madras High Court, wherein they have already held that “a message that is sent in social media is like an arrow, which has already been shot from the bow” and that the petitioner cannot plead ignorance now. Agreeing with the submissions of Government Advocate Mr. S. Santhosh, Hon’ble Court dismissed the anticipatory bail petition.
