The Guidelines for the implementation of the Reservation Policy of the Government of India in Higher Education Institutes (HEIs) introduced by the University Grants Commission (UGC) in November 2023 have caused shock and concern across the nation. If these guidelines become regulations, they will apply to all Central Universities, Deemed-to-be-Universities, and other Autonomous bodies/Institutions under the control of the Government of India, and/or receiving grants-in-aid from the University Grants Commission (UGC)/Government of India/Consolidated Fund of India.

It seems that the entire final draft regulation framed in November 2023 is aimed at depriving reservations to the SC/ST/OBC communities, and clause 10 confirms this direction. The UGC act of 1956 was created to coordinate standards in universities. Under section 12, the functions of the University Grants Commission are clearly restricted to promoting and coordinating university education, determining and maintaining standards of teaching, examination, and research in universities.

Under section 14, in case universities fail to comply with the recommendations of the UGC, the UGC will withhold the grants proposed to be made out of the funds of the commission. Reading of the UGC act of 1956 makes it clear that the UGC framed under list I entry 66 is confined only to coordinating and determining standards in higher education or research and scientific and technical institutions.

Therefore, the UGC should understand that their job under the act is only to the extent stated under section 12 and not one relating to deciding the reservation and/or abolition of reserved posts. The entire exercise undertaken by the UGC by way of calling for objections to the draft notification for the implementation of the reservation policy is without jurisdiction, illegal, and void ab initio and motivated.

This exercise undertaken by the UGC only reflects the mindset of the Union Government. The present notification is a blueprint of the BJP Government at the center for the next five years, if elected to power.

Even though the UGC Chairman has come out with a statement, the clarification does not provide any assurance that the entire draft notification will be withdrawn.

Therefore, I call upon the Hon’ble Union Minister for Education @EduMinOfIndia Hon’ble @dpradhanbjp to bring out a complete white paper on the issue, stating how and under what authority and at whose instance the UGC ventured into the present exercise of undertaking the implementation of the reservation policy in all universities, which is, in effect, akin to wiping off the existing reservation through back door methods and foul means.

I also urge the UGC Chairman, M. Jagadesh Kumar, @ugc_india to take absolute responsibility and resign for the blunder committed by the UGC, thereby hurting the feelings of the SC/ST/OBC communities and sending a shocking wave across the country.
