V.Rajaganapathy
Proprietor, Mangadu Amman Movies ::: Plaintiff

Vs.

Vijay Antony Film Corporation Private Limited
Rep. by Producer & Director, Mr.Vijay Antony ::: Defendant

Shri.V.Rajaganapathy has produced the movie titled “AAIVUKOODAM”, (earlier movie title is “Moolai”) under his banner “Mangadu Amman Movies”, which was censored by the Central Board of Film Certification in “U” Certificate No.DIL/1/117/ 2014/CHE dt. 27.11.2014.

The film titled “Aaivukoodam” staring the veteran actor R.Pandiyarajan and other co-actors, Nellai Siva, Sathya, Preethi, Ganapathy & others was produced with the following technical team engaged by Shri.Rajaganapathy:-

Director : Anbarasan, D.F.Tech,
Music : Rameshkrishna
Dubbing Studio : AVM, Chennai.
Cinematography : Mohan
Choreographer : Super Good Jeeva
Singers : Dr.Narayanan, Shrinivas, Jayalakshmi,
Richard, Kamalaja.

The film was released on 08.04.2016. The film is based on a science fiction concept of brain transplantation was originally conceptualised and produced by Shri.Rajaganapathy. After the completion of the production of the movie, the Applicant had released the movie on 08.04.2016 and the film had proven to be an unique, innovative and fascinating concept of story line. The film was a success among the viewers who had passion for science fiction. The fiction had principally dealt with the impact of an imagined concept of brain transplantation in human medical science.

Shri.Rajaganapathy was shocked to see the film trailer released by the Vijay Antony Film Corpn. through facebook on 28.02.2023, which had contained the same topic of human brain transplantation as the theme and had contained similar dialogues/script in its trailer .

Vijay Antony Film Corpn. has used a similar story line of brain transplantation as that of the film “Aaivukoodam” and has also used the similar scripts / dialogue in their movie titled “Pichaikaran-2” without the consent or permission of Mangandu Amman Movies, which amounts to infringement of the copyright owned by Shri.Rajaganapathy in the film “Aaivukoodam”.

The trailer of 4-minutes duration released by the Vijay Antony Film Corpn. on 10.02.2023 itself shows that there is infringement of copyright and there is no doubt that the film “Pichaikaran-2” is produced by copying and modifying the script/dialogue and the concept from the original work of the movie “Aaivukoodam”.

Vijay Antony Film Corpn. has infringed upon the copyrights enjoyed by the Mangandu Amman Movies over the film titled “AAIVUKOODAM” for monetary gains and commercial benefit by producing the movie titled “Pichaikaran-2” adopting the story concept of the film “Aaivukoodam” by copying the original work.

Therefore, Mangadu Amman Movies, (Shri.Rajaganapathy) has filed the suit to restraining them from infringing upon the copyright holder of the film “Aayvukoodm”.

The above suit came up before the Hon’ble High Court and has been posted to ___.04.2023 for further hearing.
