- Next story In view of the above discussion and said case law the prosecution has failed to prove the case beyond reasonable doubt and thereby the accused is entitled for acquittal. 22. In the result this criminal appeal is allowed and the judgment and conviction passed by the I Additional Special Court for NDPS Act Cases, Madurai in C.C. No.91 of 2019 is set aside and the accused is acquitted from the charges under Sections 8(c)r/w.20(b)(ii)(C) of NDPS Act and he be set at liberty subject to other cases if any. The bail bond, if any, executed by the appellant shall stand cancelled and fine amount, if any, paid by him is ordered to be refunded forthwith.
