The petitioner seeks a direction against the official respondents to consider the representation dated 14.06.2024 and pass orders for changing the alignment plan in connection with the Metro Rail Project made by the fifth respondent and approved by the sixth respondent in respect of the Five Tier Temple Raja Gopuram of Sri Rathina Vinayakar Durgai Amman Temple, Whites Road, Royapettah, Chennai.

  1. According to Mr.V.Ravi, learned Senior Counsel for the petitioner, Durgai Amman Temple is located in T.S.No.328/1, and Ratina Vinayakar Temple is located in T.S.No.327/1 and 2. There are vacant sites available near the temple and CMRL could very well build entry/exit point in those vacant sites. Learned Senior Counsel submitted that CMRL could explore the possibility of realignment.
  2. Mr.Jayesh Dolia, learned Senior Counsel for CMRL, submitted that there is no possibility of realignment at this advanced stage of work. Technically, it is
    not possible to change the plan.
  3. This Court put a suggestion to both parties about appointing an independent expert committee to inspect the said location and file a detailed
    report about the feasibility of deciding the realignment.

  4. Mr.V.Ravi, learned Senior Counsel for the petitioner, readily agreed to
    the said suggestion.
  5. Mr.Jayesh Dolia, learned Senior Counsel appearing for CMRL, submitted that he would first place on record the report submitted by the technical experts who had opined that realignment is not a possibility. On a perusal of the said report, the Court may decide the next course of action. Learned Senior Counsel also submitted that he would get instructions from CMRL about the suggestion put-forth by this Court for appointing an independent expert body to inspect the
    site and file a report.
