The Respondent humbly begs to submit as follows:

  1. The Respondent/Complainant submits that on previous hearing date, the petitioner/accused had filed a petition under section 255 of B.N.S.S,2023 seeking permission to dispense with his personal appearance before this Hon’ble Court on the ground of his advanced age and health complications.
  2. The Respondent/Complainant further submits that presently on perusing the facts, it is evident that the petitioner/accused is an elderly person, perhaps 70 years aged, who is constantly monitored by medical personnel. Furthermore, it seems reasonable that a 70-year-old senior citizen cannot be obliged to personally appear in court on a regular basis, which would negatively impact both his physical and emotional well-being.
  3. The Respondent/Complainant further submits that thereby, if this Hon’ble Court finds his reasons genuine and rational, this Hon’ble Court may dispense with his personal appearance and the respondent/complainant have no objection towards the same.

In these circumstances, it is humbly prayed that this Hon’ble Court may be pleased to pass appropriate orders by considering the Petitioner’s prayer sought in Crl.M.P.No. /2024 and thus render justice.
