[4/19, 18:09] Sekarreporter: [4/19, 13:41] Rubt Three: Ravichandran a Police Constable attached to Armed Reserve Police manning the camp of Sri Lankan Refugees in Rameshwaram was awarded life imprisonment by the District and Session’s Court of Ramanad. While on duty he shot dead his colleague in the wee hours of his duty by mistake of identity as an intruder. I appeared for him in Appeal before Justice R. Balasubramanian and Justice Late. Bhagyaraj. I argued that as a Guard on duty he warned the intruder thrice not to enter the sensitive camp and mid peak time of LTTE clashing with SL Govt camp but he entered defying the warning of the appellant and he fired at him and the person was dead. On a close look at the decease in the light it was found the dead was Constable Kovalan. The appellant had stated in his 313 questioning the warning given by him and decease defiant attitude of the deceased prompted him to shoot the intruder. This aspect was completely ignored by the Session’s Judge. The Division Bench informed me that they are also aware of the three warning system but directed me to produce the manual if shown they would allow the appeal and gave time for it but I could not secure the rule or manual or instructions due to non-availability and lost the case for a total acquittal but succeeded in converting the life sentence into one under Section 304 (II) IPC and he was released from prison as period already undergone. Lost and won in a way.

In fact several Advocates, individuals as wells persons fromMedia were present inside the Court Hall at that juncture. All the personswho had entered the premises have obtained valid passes from theauthorities concerned and therefore it has been appealed that all of themhave to be tested by the authorities concerned in order to take remedialmeasures. In fact Rapid Test Kits have to be made available to theDispensary at High Court premises and Thermal Checkup has to beconducted even at the entry points. All the Air Conditioners inside theCourt Hall have to be switched off till the end of this epidemic situation.

Accordingly, we are receiving the fund to the said account ranging from Rupees one to Five lakhs from various sources and publishing the same in our website daily for transparency. Today, The Times of India daily news paper has published the news about the payment of one rupee to the account by two persons. Based on that the Polimer Tv and Puthiatalaimurai Tv have also published the news that the Bar Council shocked over the contribution of One rupee to the Relief Fund. It is clarified that the Bar Council never shocked over the payment and it was not disrespectful neither to the Bar Council nor to the above said two contributors as published by press and media. We appreciate the spirit of contribution to the fund by each and everyone. Therefore, we request the Press and Media not to publish the news without any authenticity. [4/21, 09:07] Sekarreporter: [4/21, 09:02] Mhc Advt K. Kumaran: People lost humanity while objecting to the burial of dead body of a doctor. Very shame to our state which is known for its culture in service to the humanity. I dont know where we are heading. It’s so painful to see such incidence that too in Tamilnadu. Though the action of the High court about this bad incidence is very much appreciable, I feel usage of words by the High court that ” PUBLIC SHOULD NOT TAKE LAW INTO THEIR HANDS” could have been avoided and instead some other proper words could have been used for the reason that it gives a wrong impression that police have to take action against such burial and public should not have taken such authority in to their hands.
Suo moto action by the High court is the need of the hour.🙏
