Therefore, appointment of Special Officer to work one day in a week would be in-sufficient to deal with the affairs of ‘Kalaimaghal Sabha.’ That apart, the Special Officer has to give evidences before the Civil Courts, where suits are pending for recovery of money, property etc., wherein several crores of rupees are involved.

  1. Mr.R.Singaravelan, learned Senior Counsel appearing on behalf of the petitioner would oppose by stating that it is a statutory appointment to deal with several crores of public money, where large scale irregularities and illegalities are identified. Therefore, appointment of Special Officer to work one day in a week would be in-sufficient to deal with the affairs of ‘Kalaimaghal Sabha.’ That apart, the Special Officer has to give evidences before the Civil Courts, where suits are pending for recovery of money, property etc., wherein several crores of rupees are involved.

That being so, appointment of Special Officer made under the Act must be a whole-time appointment for the purpose Of protecting the interest of the public, who have invested their hard-earned money 25 to 30 years back. The State is duty bound to protect the interest of such investors in consonance with the Act.

    f this Court, such Special Officer must bc a whole-time Officer for the purpose of perfoming the duties, so as to ensure that the settlements to the investors
    as expeditiously as possible. Almost 25 years have been lapsed. That
    being the factum, the Authorities are expected to be sensitive in such matters of public interest, wherein huge money is involved. State is duty bound to protect the investors under the provisions of the Act.
  4. The Status Report filed by the Inspector General of Registration reveals that he is conducting weekly meetings regularly. However, all such actions must be made in a time bound manner, so as to ensure that the victims see the light of the day.
  5. Mere reviewing of the performance would be insufficient and actions must be in a time bound manner. Failing which, there is a possibility of dragging on the matter by the Authorities, which cannot be accepted by this Court.
  6. In view of the implications and the quantum of work involved to be resolved and to have personal discussion, the Secretary to the Government, Commercial Taxes and Registration Department, Fort St.George, Chennai and the Inspector General of Registration are directed to appear before this Court either through online or in-person, as per their convenience, enabling this Court to discuss httpsJ/www. take a decision to protect the interest of the victims, who all are large
