The petition has been filed seeking a direction to the second respondent, Inspector of Police (Law and Order), G3, Kilpauk Police Station, Chennai to register an FIR on the complaint given by the petitioner on 12.1.2022.

It is the case of the petitioner that he is aged about 62 years and he has been permanently residing at Door No.11/4, Halls Road, Kilpauk, Chennai 10, for the past 15 years having derived the same from his mother in law and one Haneefa had entered into an agreement of sale with the petitioner’s mother-inlaw with regard to the property in question on certain terms, however, it did not fructify due to some dispute with regard to sale consideration, and such being the position, the said Haneefa had chosen to lodge an undated complaint to the Deputy Commissioner of Police, Kilpauk Range on 11.01.2022 at 11 hours making some false allegations, and based on such a false complaint, a case has been registered by G3 Inspector of Police, Kilpauk Police Station on the same day in Crime No.19/2022 for offences under Sections 454, 420, 511, 294(b), 352, 506(i) IPC and the petitioner was taken to the police station on 12.01.2022 at 05.30 a.m. and he was kept in the police station. While he was detained in the police station, his house was demolished and razed by a JCB and he was thrown out of his possession. After the entire operation has been completed, the petitioner was let out on the same day by 10.00 p.m. In respect of the illegal activity of the police in collusion with the said Haneefa, the petitioner had given a complaint to the higher Authorities viz., Joint Commissioner of Police, East, on the same day, however, no action has been taken and hence, the petitioner is constrained to file the present petition.

The allegation seems to be very serious in nature as it relates to a senior citizen being harassed with the aid of police personnel in a high-handed manner in detaining him in police custody and demolishing his shelter. Further, a perusal of the present complaint lodged by the petitioner reveals that on 24.11.2021 itself, the petitioner had lodged a police complaint in CSR 708/2021 against the said Haneefa for having threatened the petitioner with dire consequences, however, without there being any action on the same, the petitioner has been subjected to ordeal on the basis of the complaint made by the other party in a partisan manner that too in a matter where civil dispute is involved.
4. Therefore, the Additional Commissioner of Police, Chennai City
Police, Chennai is directed to secure the Hard Discs relating to the Closed Circuit Cameras in G3 Kilpauk Police Station and preserve the CCTV footages of G3 Kilpauk Police Station in respect of the period from 11.01.2022 06.00
a.m. to 13.01.2022, 06.00 a.m..
5. The learned counsel for the petitioner is directed to produce the proof of the residence of the petitioner for the past 15 years.
6. The CD file in Crime No.19/2022 is retained by this Court.
