This Writ Petition has been filed challenging the order dated 02.08.2022 passed by the fifth respondent calling upon the petitioner-School to shift their students to a near-by School on the ground that the petitioner-School is not having recognition and is also not having the approval of the Director of Town and Country Planning (DTCP).

  1. The learned counsel for the petitioner drew the attention of this Court to various Government Orders which have been filed along with the Writ Petition. He further submitted that the petitioner has been fighting for recognition for the School right from the year 2011 onwards. But till date, despite the petitioner’s best attempts, the recognition has not been granted. Earlier, admittedly, the petitioner’s application seeking for recognition was rejected. Aggrieved by the same, the petitioner filed a Writ Petition in W.P.No.26410 of 2021, which is still pending on the file of this Court. The petitioner is also not having any benefit of interim order in the said Writ Petition. Therefore, at this stage, unless and until the counter affidavit is filed by the respondents, a final decision cannot be taken in this matter by this Court. However, a categorical assertion has been made by the petitioner in this Writ Petition that similarly placed Schools in Salem District are running the Schools without recognition and even without DTCP approval for a very long time and the same is refuted by the learned Additional Government Pleader appearing for the respondents.
  2. Post the Writ Petition and connected miscellaneous petitions, for counter and disposal on 09.09.2022 along with W.P.No.26410 of 2021.
  3. However, it is made clear that if it is brought to the notice of the respondents that Schools are being run without recognition and without the DTCP approval in the Salem District, they have to initiate legal action against those Schools also, as is done for the petitioner-School.
