COMPLAINT UNDER SECTION 199(2) OF Cr.P.C. FOR OFFENCES PUNISHABLE UNDER SECTION 500 OF THE IPC
The complainant is the City Public Prosecutor, Chennai and the address for services of all notices and processes on the complainant is the “Office of the City Public Prosecutor, City Civil Court Buildings, High Court Campus, Chennai-600 104”.

  1. The present Complainant is preferred under section 199(2) of the Code of Criminal Procedure read with Section 500 of the Indian Penal Code, on account of the offence that has been committed against the Hon’ble Chief Minister of Tamil Nadu, in respect of his conduct in the discharge of his public functions and hence this Complaint is being filed under section 199(2) of the Code Criminal Procedure 1973, before this Hon’ble Court.
  2. The complainant submits that the address for services of all notices and processes on the Accused is as stated above.
  3. The Complainant state that the present complaint is consequent upon the wilful and conscious action of the Accused in defaming the Hon’ble Chief Minister of Tamil Nadu in respect of his conduct in the discharge of his public functions vide scandalous statements made by the Accused on visual media (https://twitter.com/annamalai_k/status/1763215861677252774) running to 11 Minutes and 35 seconds, alleging that the Hon’ble Chief Minister of Tamil Nadu is involved in the distribution of contraband, Viz. Pseudoephedrine, by aiding drug peddlers, and thus causing significant harm to the goodwill and reputation of the Hon’ble Chief Minister of Tamil Nadu in the eyes of his peers and the general public, with the malicious intent of gaining unjust political advantage.Further, the following statement/post has also been stated along with the said visual media;
    “Here’s an appeal from @BJP4TamilNadu to the people of TN to join hands to make our society Drug-free as our repeated requests to the DMK Government in TN have been neglected as their allegiance is with the drug peddlers & not the common people.” (emphasis supplies)
  4. The complainant submits that the Accused in a visual media published in Twitter (also known as ‘X’) platform on 29.02.2024 at 08:23 made defamatory statements intending to harm the reputation of the Hon’ble Chief Minister, Government of Tamil Nadu in respect of his conduct in the discharge of his public functions.
  5. The complainant submits that this complaint is being filed seeking to prosecute the Accused for his defamatory speech without any basis or evidence. Though the contents on the visual media in its entirely amounts to defamation, since the transcript of the entire statement is filed along with the present complaint, for the sake of brevity, few of such defamatory statements are extracted below:
    “அன்பார்ந்த சகோதர சகோதரிகளே பெரியோர்களே தாய்மார்களே, ஒரு முக்கியமான விஷயத்தை உங்களிடம்பேசுவதற்காக இந்த வீடியோ பதிவு. கடந்த ஒரு பத்து நாட்களாக பல அதிர்ச்சியான சம்பவத்தை தமிழகத்திலே பார்த்துக்கொண்டிருக்கின்றோம். குறிப்பாக, திராவிடமுன்னேற்றக்கழகம் ஆட்சிக்கு வந்த பிறகு drugs, ganja, synthetic drug இது அனைத்துமேபொது வெளியில சர்வசாதாரணமாக எல்லா இடத்திலும் கூட கிடைக்க ஆரம்பித்து இருக்கிறது. இது எல்லாருமே நம்முடைய என் மண் என் மக்கள் யாத்திரை பயணத்தின் போது நிறைய தாய்மார்கள் அதைசொன்னாங்க. பட்டித்தொட்டியெல்லாம் கிராமம் வரைக்கும் drugs வந்திருச்சு. இதை பெரும் முயற்சி எடுத்து கட்டுக்குள்கொண்டு வரவேண்டுமென்று. திமுக அரசு குறிப்பாக இந்த 33 மாத காலத்தில வரலாறுகாண முடியாத அளவுக்கு தமிழகத்துல drugs புழக்கம் அதிகமாகி இருக்கு. அதுவும் இந்த 10 நாட்களாகவந்த செய்தி நமக்கு ஒரு ஊர்ஜிதத்தை கொடுக்குது, எந்த அளவுக்கு இதனுடையதொடர்பு அரசியல் தொடர்பு, சினிமா தொடர்பைத் தாண்டி வேறுவேறு அயல்நாடுகளுடைய தொடர்பு. நீங்க பாருங்க திமுகவுல ஒரு மனிதர் அயலக அணி பொறுப்பை வாங்குகிறாரு, அப்படின்னா வெளிநாட்டில் இருக்கக்கூடிய எல்லா நாடுகளுக்கும் ஒரு பொறுப்பாளர் ஒருத்தர் வாங்குகிறாரு. அதே மனிதர் ஒரு சினிமா கம்பெனி நடத்துறாரு jsm productions அப்படின்னு. ஜாபர் சாதிக் என்கின்றமனிதன்ஒருபெரிய drug network-னுடைய தலைவராகஇருக்கிறார்.… … …

  6. The entire transcript of the speech of the Accused along with the defamatory accusations against the Hon’ble Chief Minister and the Government of Tamil Nadu is enclosed as a document which may be read as part and parcel of this complaint.
  7. The complainant submits that the rationale for the procedure engrafted by Section 199(2) Cr. P.C. of the Code carves out a special procedure with regard to the initiation of a prosecution for the offence of defamation committed against a public servant/constitutional functionary as the same relates to Discharge of Public Functions by the public servant/constitutional functionary, as such, the present complaint is filed by the Public Prosecutor as contemplated under section 199(2) Cr.P.C.
  8. The complainant submits that the aforesaid statements of the Accused clearly constitute defamation as defined under Section 499 of the IPC and the defamatory statement has a direct and reasonable nexus with the discharge of public functions of the Hon’ble Chief Minister.
  9. The complainant states that the Hon’ble Chief Minister being the head of the Council of Ministers, along with the Cabinet Ministers, are collectively responsible for every executive act, irrespective of the assignment of specific department/portfolioto each Ministers and as such, the Hon’ble Chief Minister along with the Council of Ministers are collectively involved in the discharge of public function connected with all the departments.
  10. While the Hon’ble Chief Minister has taken various steps towards ‘Drug free Tamil Nadu’, the present defaming statements of the Accused falsely links the Hon’ble Chief Minister to the distribution of contrabands by aiding drug peddlers. The entire contents of the defaming visual media as a whole, would clearly show that that the Accused is associatingthe Hon’ble Chief Minister with the distribution of contraband.
  11. In fact, the Hon’ble Chief Minister, in course of discharging his public function, speaking at the State Level Conference on Anti-Drug Abuse in 2022, gave the call to eliminate narcotic drugs from the State, pursuant to which numerous measures were taken, as is evident from the Policy Note 2023-2024 of the Department of Home, Prohibition and Excise, Government of Tamil Nadu. Few of such measures taken by the Hon’ble Chief Minister along with his council of Ministers are as follows;

Law Enforcement Activities:
i. Due to the efforts taken by Tamil Nadu Police, the State is maintaining ‘Zero Cultivation’ status of Ganja.
ii. During the year 2022, a total of 10,665 cases were detected resulting in arrest of 14,934 accused including 19 foreign nationals and seizure of 28,383 Kgs. of Ganja, 63,848 Tablets and 98 Kgs. of other drugs.
iii. Action was taken against Interstate drug cartels involving individuals from Andhra Pradesh, Karnataka, Odisha and Telengana.
iv. Statewide joint raids were conducted along with drug inspectors against pharmacies selling prescription medicines to minors without proper documents.
v. During the Ganja&Gutkha Operation-1.0 from 06.12.2021 to 05.01.2022, a total of 1,272 NDPS cases have been registeredresulting the arrest of 1,221 accused andseized 2,299 Kgs. of Ganja and 23 Kgs. ofHeroin.
vi. In Ganja&Gutkha Operation – 2.0 from28.03.2022 to 27.04.2022, a total of2,023 NDPS cases have been registeredresulting the arrest of 2,423 accused and3,562.50 Kgs. of Ganja was seized.
vii. To stop the sale of Ganja near Schoolsand Colleges, special checks wereconducted at the shops in the vicinity ofthe educational institutions. In addition tothis, awareness campaigns have beenconducted in schools and colleges toeducate the youth regarding the ill effectsof Ganja and other Narcotic substancesand Psychotropic substances.
viii. In addition to creating awareness,stringent enforcement action under NDPSAct is being taken by the Tamil NaduPolice leading to higher seizure ofNarcotic drugs & Psychotropic substancesin the year 2022 compared to earlieryears.
ix. Financial investigation has been initiatedin 72 cases filed against narcoticsoffenders and 151 moveable andimmovable properties all worth aboutRs. 17.87 crore were seized.
x. 4,994 bank accounts pertaining to theaccused concerned with NDPS Act casesand their relatives / friends bearingbalance of Rs. 2.00 crore were frozen under section 102 Cr.P.C.
xi. 11) In order to watch the activities ofprevious offenders involved in NDPSCases, a total of 24,880 accused involvedin cases from 2019 onwards have beenlisted out. Of which, about 12,000accused are lodged in jails. 5,495accused have been bound over andsecurity bonds have been executed. Ofwhich, 195 accused have been arresteddue to breach of bond condition.
xii. Cyber Cell was set up in NIB CID with3 computers and software sanctionedunder DGP/ HOPF’s discretionary fund.
Awareness Activities:
i. In order to create awareness amongyoungsters especially students, theEnforcement Bureau Unit organized amass Anti-Drug Abuse Pledge throughoutthe State on 11.08.2022. The State Level function was led by the Hon’ble Chief Minister of Tamil Nadu and more than 74 Lakh students of Schools and Colleges took the pledge on the same day and same time across the State of Tamil Nadu. The effort has been recognized as ‘World Record’ by the World Record Union.
ii. A 20 minutes Awareness video incorporating message of the Hon’ble Chief Minister of Tamil Nadu and ill effects of drugs was prepared and shared to all schools and colleges for showing the same to students.
iii. Anti-Drug Clubs have been formed in 14,000 educational institutions aimed to protect the students from the threat of drug addiction by including students as stakeholders.
iv. NSS Volunteering Programme provides the opportunity for NSS to volunteer with the Drive against Drugs (DAD) movement.
v. Social media awareness campaign was launched using the awareness campaign fund.
vi. Website for NIB CID and an awareness film against drug abuse is under preparation.
vii. 3 sniffer dogs were purchased and they are under training for narcotics detection. Totally 10 sniffer dogs are available in Tamil Nadu for anti-narcotics operation.
Formation of Enforcement Bureau CID
i. The Hon’ble Chief Minister of Tamil Nadu made an announcement that the Prohibition Enforcement Wing will be merged with Narcotic Intelligence Bureau CID Unit for effective action against Narcotic drugs and Psychotropic substances. In accordance with the announcement, orders were issued regarding formation of the Enforcement Bureau CID of Tamil Nadu.
ii. The newly formed “Enforcement Bureau CID” has the responsibility for enforcement of Tamil Nadu Prohibition Act, Narcotics Drugs Psychotropic Substances Act, Prevention of Illicit Traffic in Narcotic Drugs Psychotropic Substances Act and Intellectual property rights.
iii. Each District will have Enforcement Bureau CID Units. The strength of existing Prohibition Enforcement Wing units has been rationalised and additional responsibility of enforcement of NDPS Act has been given to district Enforcement Bureau CID units.

  1. The complainant submits the under the astute leadership of the Hon’ble Chief Minister, the State of Tamil Nadu has witnessed a remarkable transformation through the formulation and implementation of innovative welfare schemes. With unwavering dedication to the welfare of every citizen, the Hon’ble Chief Minister has exemplified visionary governance, ensuring that no individual is left behind in the march towards progress and prosperity.Through meticulously crafted policies, the Hon’ble Chief Minister has addressed critical issues such as healthcare, education, and employment, fostering an environment of inclusivity and empowerment. These welfare schemes stand as a testament to the Hon’ble Chief Minister’s commitment to uplifting the marginalized sections of society, providing them with the necessary tools and opportunities to thrive. With a blend of compassion and strategic foresight, the Hon’ble Chief Minister has not only improved the lives of countless individuals but has also set a shining example for effective governance nationwide. Few of the welfare schemes formulated/improvised by the Hon’ble Chief Minister are as follows;

  2. The complainant submits while the Hon’ble Chief Minister has, inter alia, taken numerous steps as mentioned above in respect of his discharge of his public function, the aforesaid defamatorystatements made by the Accusedare not only false, but also crafted with the explicit purpose of tarnishing the reputation of the Hon’ble Chief Minister of Tamil Nadu. This Statement has inflicted significant damage upon the esteemed Hon’ble Chief Minister.
  3. The complainant submits that the said defamatory statement of the Accused strike at the very core of ethical governance and public trust, tarnishing the reputation of the esteemed office and undermining the principles of justice and integrity.The responsibility entrusted upon the Hon’ble Chief Minister is not merely administrative but also moral, requiring the highest standards of conduct and accountability. Any association with illicit activities, particularly those as detrimental as drug trafficking, betrays the trust placed in an elected representatives and undermines the fabric of our democracy.The consequences of such defamatory statement extend far beyond mere political rivalry; they have the potential to inflict irreparable harm upon the social fabric of the State.
  4. The complainant submits that the Accused was driven by political animosityand has maliciously attempted to defame the Hon’ble Chief Minister’s reputation through the defamatory allegations outlined above. While the Government of Tamil Nadu and the Hon’ble Chief Minister of Tamil Nadu are open to constructive criticism founded on factual evidence, these particular allegations are inherently defamatory and solely intended to tarnish the Chief Minister’s reputation without any genuine public interest.
  5. The complainant submits that the above-mentioned defamatory speech is not only devoid of truth and devoid of good faith, but it has been deliberately crafted to undermine the public interest. The act of defamation against the Hon’ble Chief Minister of Tamil Nadu pertains to actions taken in the course of discharging public duties by the Chief Minister.
  6. The complainant submits that the statements were not made with genuine intentions but rather with a malicious intent to defame the Hon’ble Chief Minister solely for the personal political advantage of the Accused.
  7. The complainant submits that the imputations made by the Accused have diminished the moral standing and reputation of the Hon’ble Chief Minister in the perception of the general public.
  8. The complainant submits that the said statements made by the Accusedthathas come to be widely circulated in television and online media is an attempt to discredit the credibility ofthe Hon’ble Chief Ministerand to launch a smear campaign against the Hon’ble Chief Minister.The said statements have been published by the Accusedwith the sole mala fide intention of causing disrepute to the Hon’ble Chief Minister. The said statements have already caused severe disrepute to the Hon’ble Chief Minister amongst the public.
  9. It is submitted that the said defaming statements posted bythe Accused on ‘X’ (Formerly knowns as Twitter) has been circulated on various other social media pages and the same has garnered several thousand views due the sensationalist content of the same.
  10. It is submitted that any responsible prudent person, upon receipt of allegation of the present nature, which will have far-reaching implications, would have attempted to verify the truthness of the allegation, however, no such attempts have been made by the Accused in the present case and proceed to publish the same in social media with an intention to defame the Hon’ble Chief Minister.
  11. It is submitted that the Accused has not cited any evidence to prove the veracity of his allegations published in the visual media and the allegations themselves are not specific but a vague story concocted by the Accused for political benefit and to cause confusion and unrest among the general public.
  12. It is submitted that the Accused, acting directly and through various unknown persons have continued to circulate the said defamatory video, despite knowing well the falsity of the allegations made by the Accused. It is stated that these statements are being widely circulated in online media, social networking, whatsapp and video sharing sites and thus causing irreparable harm of reputation to the Hon’ble Chief Minister.

The Accused have been consciously andwilfully indulging in publishing and propagating malicious, false and defamatory information about the Hon’ble Chief Minister, being well aware of the fact that such statements would tarnish the reputation and goodwill of the Hon’ble Chief Ministeramongst the public.
  14. The Complainant submits that the statements made by the Accusedimpeaches the reputation of theHon’ble Chief Minister, Government of Tamil Nadu.The complainant submits that the Accused hascaused immutable injury to the reputation of theHon’ble Chief Minister, Government of Tamil Nadu andhis statements contain both theelements of mens-rea and actusreus.

The Complainant submits that the government of Tamil Nadu after careful consideration of the materials placed before it has accorded sanction to the complainant under section 199(4) Cr.P.C. vide G.O. Ms. No._209 dated 12-03-2024 for filing the present complaint before the Competent Court. Further, a plaint reading of the said GO would clearly reflect application of mind by the sanctioning authority.
  16. The complainant submits that sanction has been accorded by the sanctioning authority upon being fully satisfied that the defamatory statements are reasonably linked to the discharge of public functions by the Hon’ble Chief Minister and the Government of Tamil Nadu. The complainant further submits that he is also satisfied that the statements are not only defamatory in nature but have a direct nexus with the discharge of public duties of the office of the Hon’ble Chief Minister of Tamil Nadu
  17. The complainant submits that after a thorough review of all the materials, including the electronic version of the visual media containing the statement of the Accused and the transcript of the same and upon full satisfaction that the same constitutes an offence punishable under Sec. 500 of IPC and falls within the ambit of Sec.199 of Cr.P.C, the present complain has been brought before this Hon’ble Court.
    Hence, it is humbly prayed that this Hon’ble Court may be pleased to take cognizance of this complaint, issue process and proceed against the Accused and punish for the offences under Section 499 and 500 IPC and pass such further or other orders as this Hon’ble Court may deem fit and proper and thus render justice.
