In view of the above, we direct handing over of the management of the Dargah from the Committee constituted by the High Court to the Trustees and accordingly charge of the Dargah would be taken by the Trustees from the Wakf Board within a week.

Heard the learned counsel for the parties.  This Court passed an order in regard to the handing over of the management of the Dargah to the Committee.   The learned counsel appearing for the Committee submits that it does not want to continue any more and therefore the

management of the Dargah has been given to the Wakf Board.

  1. The learned counsel appearing for other parties submitted that the management of Dargah has to be given to the Trustees and Advisory Board as per Scheme Decree in O.S.No.30 of 1946 and the Mediation Award.
  2. In view of the above, we direct handing over of the management of the Dargah from the Committee constituted by the High Court to the Trustees and accordingly charge of the Dargah would be taken by the Trustees from the Wakf Board within a week.
  3. The Wakf Board is directed to give the management of the Dargah to the Trustees as per the Scheme Decree in O.S.No.30 of 1946 and the Mediation Award. Insofar as the other issues are

concerned, the same would be decided on next date of hearing.

  1. A request has been made by the learned counsel appearing for the members of the Committee to remove the allegations made in the order dated 23.02.2022. The aforesaid request is accepted. However, the issue would be taken up again in reference to the arguments made by the parties if they still want to press the allegations about the management of the Dargah by the Committee.

Post the matter on 15.06.2022.
