Supreme court files a case against Delhi High court
Chief minister using the govt is not incongruous.
If chief minister salary is not paid then he has to sue his own govt.!
The supreme court has only held that it is the state which can sue the union govt and not the chief minister in state of Rajasthan case.
But there is no bar in chief minister using his own govt for any wrong doing!!

Honourable Chiefminister filed this case as PIL when he was Opposition Leader. Now as Chiefminister he can redress the grievances. Honourable Highcourt order is not necessary. Your references are factually different. Please consider.

Therefore it is better the HC decides the issue on merits and give appropriate directions.
