‘I love the little boy you are now and the man you will become.’ This is the love of the parents for their son in the case in hand. The loving parents were put to shock when the son forbade them at their time of utmost necessity.

With the fond hope that the son will be bounden by the values that he is brought up and in acknowledgement of the deep love, the parents wrote a Settlement Deed, settling their hard-earned property to the eldest son. The happy son well settled abroad, immediately acts upon the Settlement Deed and the same is brought into force. Gradually, worldly pleasures foretake the values implanted in him by his parents and he moves away from the elderly parents who live with the only hope i.e., the son, in mind.

The father falls sick and the mother takes care of him. The mother also falls sick and there is no one to take care of them. There is no reply from the two sons for the call for help from the parents. Holding hope, the father writes an empathetic message to the elder son which would even melt a stone. The elder son does not heed to the cries of the father disabled by sickness and age. They sold their jewels and spent the little money they had saved for all the treatment expenses and got up gaining a little strength.

The pathetic state of the parents push them to take a decision to cancel the Settlement Deed executed in favour of their elder son. The son who did not respond to the cries of the parents immediately turned up, not to see the parents but to drag them to the Court, when the document gets cancelled.

The son challenged the cancellation of the Settlement Deed as null and void but the Trial Court did not accept the case of the son. The enraged son without any empathy approaches the doors of the next Court. The First Appellate Court failed to consider the merits of the case and agreed with the son. Now it is the turn of the parents to approach the High Court for the redressal of their grievances. Though the parents had no wherewithal to file a case in the High Court, the Legal Services Authority extended the helping hand to them.

The Hon’ble High Court speaking through Hon’ble Justice P.T. Asha, who heard the arguments of M/s. Sharada Vivek for the aged parents through the Legal Services Authority, gave back the life to the parents. While upholding, the act of the parents in cancelling the Settlement Deed, Hon’ble Justice P.T. Asha, sent a universal message to all the sons and daughters out there, by citing a Thirukkural, which speaks about the way of life and how a child should make the parent feel proud about the values they inculcated in the child.

The crying e-mail of the father which did not move the son, moved the Court through which Hon’ble Justice P.T. Asha sent a strong message to the children who desert and neglect their parents. The Court invoked S. 23 of the Maintenance and Welfare of Parents and Senior Citizens Act and declared that the parents are entitled to cancel the Settlement Deed, when the children fail to maintain the parents. This Judgement of Hon’ble Justice P.T. Asha is a light house for all the deserted parents and a guiding star for the children.

அந்த வழக்கில் உயர்நீதிமன்ற சட்ட உதவி குழுவின் உதவி பெற்ற பெற்றோர்களுக்காக வாதாடும் வாய்ப்பு எனக்கு கிடைத்தது. இந்த வழக்கில் பெற்றோர்கள் அன்பைக் கொட்டி வளர்த்ததோடு, தன் பிள்ளை தன்னை ஆயுள்வரை பராமரிக்க வேண்டும் என்ற நிபந்தனையோடு தன் சொத்துக்களை மூத்தபிள்ளைக்கு தான செட்டில்மென்ட் எழுதி வைத்தார்கள். பயன்படுத்திவிட்டு பாராட்டு என்பதை மாற்றி”பயன்படுத்திவிட்டு பின்பு தூக்கி எறி” என்ற பரவிவரும் கலாச்சாரத்தை கையில் எடுத்துக்கொண்டு, எழுதிக்கொடுத்த சொத்துக்களை மட்டும் எடுத்துக்கொண்டு பெற்றோர்களை மகன் பராமரிக்க மறுத்துவிட்டான். நான்கு அறுவை சிகிச்சைகளுக்குப் பிறகும் நிராதரவாய் நின்றுகொண்டிருந்த பெற்றோர்களை திரும்பிப் பார்க்க மறுத்து விட்டான்.அந்தப் பிள்ளைக்கு பாடம் புகட்ட பெற்றோர்கள் தாங்கள் எழுதிக்கொடுத்த செட்டில்மெண்ட் ரத்து செய்தார்கள். அப்படி செய்ய பெற்றோர்களுக்கு உரிமை இல்லை என்று மூத்த பிள்ளை நீதிமன்றத்திற்கு சென்றார். பெற்றோர்கள் செய்தது சரியா? பெற்றோர்களுக்கு அப்படி செய்ய அதாவதுஎழுதிக் கொடுத்து விட்ட சொத்தை திரும்ப எடுத்துக்கொள்ள உரிமை உள்ளதா என்பதுதான் உயர் நீதிமன்றத்துக்கு முன்பாக இருந்த கேள்வி.
மூத்த குடிமக்கள் பராமரிப்பு சட்டத்தின்கீழ், பிள்ளைகள் பெற்றோர்களை பராமரிக்க மறுத்தாலோ அல்லது நிராகரித்தாலோ அல்லது ஒப்புக்கொண்ட உத்தரவாதத்தை மீறினால் கொடுத்த சொத்தை பெற்றோர்கள் திரும்ப எடுத்துக்கொள்ளலாம் என்று மாண்புமிகுநீதியரசர் ஆஷா அவர்கள் தீர்ப்பு சொல்லி இருக்கிறார்கள்.
இந்த தீர்ப்பு அறம் செய்ய விரும்பு என்று சொல்லிக் கொடுத்த பெற்றோர்களையே அறவழி தவறி ஏமாற்றும் பிள்ளைகளுக்கு ஒரு சாட்டையடி.
அன்பு ஆதரவு உழைப்பு சொத்து என்று எல்லாவற்றையும் இழந்து கடைசியில் பிள்ளைகளின் அன்பு கிடைக்காமல் சொல்லவும் முடியாமல் மெல்லவும் முடியாமல் ஊமையாய் அழும் பெற்றோர்களுக்கு ஒரு பெரிய நம்பிக்கை நட்சத்திரம்.

The bench disposed of 2085 cases since its sitting on September 5. Of these, 938 were main cases including 776 writ petitions, 147 writ appeals and 1147 miscellaneous cases. The bench also disposed of cases that had been pending for more than six years.

*Honourable Mr. Justice G.K. Ilanthiraiyan* allowed the Criminal Original Petition in the matter relating to *“FIR Quash – IPC S. 117, 143, 188 – Freedom of Speech/Unlawful Assembly”* and observed and held as follows:

i) The petitioners raised slogans condemning against the implementation of National Education Policy 2020 by the Union Government, without getting prior permission from the concerned authority. Therefore, the respondent police levelled the charges under Sections 143, 188 and 117 of IPC.

ii) From Section 195(1)(a) of the Criminal Procedure Code, it is clear that for taking cognizance of the offences under Section 188 of IPC, the public servant should lodge a complaint in writing and other than that no Court has power to take cognizance.

iii) Caselaws cited: *(1) Mahaboob Basha Vs. Sambanda Reddiar and others [1994(1) Crimes, Page 477]; (2) Jeevanandham and others Vs. State rep. by the Inspector of Police [2018-2-L.W. (Crl.) 606].*

iv) Respondent Police is not a competent person to register FIR for the offences under Section 188 of IPC. As such FIR is liable to be quashed. Further, the complaint does not state as to how the protest formed by the petitioners and others is an unlawful protest and does not satisfy the requirements of Section 143 of IPC. Therefore, final report is liable to be quashed.

This recent trend of alleging scurrilous comments and smear campaigns against the Judges of Hon’ble Supreme Court and it’s judges are increasing especially when an eminent Judge is going to take position of the Hon’ble Chief Justice of India.
This degrading trend of tarnishing the Judiciary’s image continues from the term of Hon’ble Justice Ranjan Gogoi and it happened to Hon’ble Justice N.V.Ramana and now Hon’ble Justice D.Y.Chandrachud. These type of erring people scandalizing the Judiciary must be dealt with iron hands. The bar and the bench must strive together to save the dignity and decorum of this Judicial forum and protect the Judiciary from such transgressions.
The Tamil Nadu Advocate Association hereby condemns the irresponsible, slanderous statement and warns to take legal action against all such perpetrators and disgruntled elements.

*Honourable Mr. Justice R. Suresh Kumar* disposed of the Writ Petition in the matter relating to *“College – Autonomous Status – UGC”* and observed and held as follows:

i) With regards to power with the UGC to independently consider the application submitted by management/colleges for autonomous status, the issue has already been decided in *Annapoorana Engineering College Vs. Anna University and another [W.P.No.7377 of 2021] (MHC)*, wherein it was held that:
a. W.A.No.51 of 2020 has thrown a light, where, the legal position has been explicitly stated as to the status of the UGC for considering the application submitted by the institution concerned independently for the purpose of declaring it as an autonomous institution and it had attained finality by the orders of the Supreme Court.
b. This being the position, there can be no impediment for UGC to independently consider the application.
c. Where, the application initially has to be routed through the affiliating University, then the University can either forward the same to the UGC with its recommendation or the University can reject the same with reasons
d. Even if it is rejected, according to Regulation 7(3) [University Grants Commission (Conferment of Autonomous Status Upon Colleges and Measures for Maintenance of Standards in Autonomous Colleges) Regulations, 2018 (in short ‘2018 Regulations’)] it has to be forwarded only to the UGC for further action at the end of the UGC to take decision on its own merits.

ii) Therefore, whether the report of the University would reach within 30 days or not, it is for the UGC to decide the application and independently pass orders on merits within a reasonable period.

iii) Therefore, The UGC, after completion of inspection and taking into account the report of the University, is directed to complete the process of application for autonomous status within 4 weeks.
