[7/31, 20:16] sekarreporter1: The Supreme Court upholded PSTM quota interpretation that under “TN appointment on preferential basis in services under the state of persons studied in Tamil Medium Act 2010” persons who have studied from first standard to qualifying course of education for recruitment in Tamil alone is entitled for reservations of 20% after hearing the arguments of P. Wilson Senior Advocate appearing for Government of Tamilnadu and TNPSC.
The bench comprising of Hon’ble Justice Hrishikesh Roy and Hon’ble Justice Pankaj Mithal dismissed SLP filed by one S Sriram who challenged the applicability of Amendment act 2020 to the TNPSC Group I CCS I recruitment notification on the ground that only after amendment such eligibility was prescribed and that it could be prospective . The Madurai bench of Madras HC interpreted that only when a candidate completes his education in Tamil at all level , the PSTM quota is applicable. The Highcourt also upheld the PSTM 2020 amendment Act clarifying the definition of “persons who studied in tamil medium “
The Petitioner counsel Romil Pathak argued that the rules of game cannot be changed when game started and hence the Amendment act could only be considered as prospective .
Mr P. Wilson argued that the amendment act 2020 is classificatory and declaratory in nature and applied retrospectively even to the recruitment notification which was issued prior to Amendment Act.
He submitted that the intention of the act is to help the persons who Pursue tamil medium at all levels and not restricted to qualifying course alone.
