ORDER:

During the Demand of this Department for the year 2022-2023, the Hon’ble Minister for Minorities Welfare and Non-Resident Tamils Welfare had made the following announcement on the floor of Tamil Nadu Legislative Assembly:-

  1. Accordingly, the Director, Minorities Welfare in his letter dated 26.04.2022 has stated that the following guidelines may be framed to dispose applications conferring Minority status to all categories of Educational Institutions:-
  2. The object of the Educational Institutions should be for promoting the interests of the minority concerned and it should sub serve the interests of the minority community concerned;

Il. Such Educational Institutions should have been established by the minority and should be continuously administered only by the member of that minority;

  1. An Educational Institution which was originally not established by a minority community cannot acquire such status or character subsequently under any circumstance;
  2. All the Trustees or members of the Governing Body of the minority Educational Institutions shall belong only to the concerned minority;
  3. In the case of self-financing Educational Institutions imparting professional courses of education established and administered by any minority they shall admit students of that minority alone, not exceeding 50% of the sanctioned strength. If there is any vacancy not filled as above, such vacancy in that 50% shall be filled up only ori the basis of merit and from common merit list prepared by the competent authority;
  4. To decide whether an applicant is a minority or not based on religion or language, the total population of that minority in the State of Tamil Nadu shall be taken into consideration and not the population of that minority in any particular region where the Educational Institution is situated;
  5. The Director of Minorities Welfare has further proposed as follows:-
  6. The Directorate of Minorities Welfare shall be the Nodal Office to receive applications seeking Minority status for all types of Educational Institutions like the Schools, Arts and Science

Colleges, Technical Education Institutions, Agriculture, Law, Medical College etc;

  1. Upon receipt of applications, within fifteen days, the Director of Minorities Welfare shall cause basic verification and send the verified applications to concerned Heads of the Departments for further scrutiny;
  • The Heads of the Departments within fifteen days shall verify the eligibility of the applicant institution for conferment of

Minority status and send the same to the Director of Minorities Welfare;

  1. Director of Minorities Welfare, upon completion of scrutiny of application place the same before the Empowered Committee;

An Empowered Committee under the Chairmanship of Principal  Secretary, Backward Classes, Most Backward Classes and Minorities Welfare Department with the following members shall be ordered to be constituted for scrutiny of applications for issuing certificate of Minority Status for Educational

Committee, the Director of Minorities Welfare may issue Minority

Status Certificate to the Educational Institutions;

  1. The Government, after careful consideration of the proposal of the Director of Minorities Welfare and ordered as follows:-
  2. To implement the announcement made on the floor of the Assembly for the year 2022-2023 in respect of conferring of

Minority Status to Educational Institutions through this Department;

Il. To constitute an Empowered Committee under the Chairmanship of Chief Secretary with 8 Secretaries as Members for scrutiny of applications for conferment of Minority Status to Educational Institutions by Directorate of Minorities Welfare:-

Ill. The Minority Educational Institutions must fulfill the following criteria : –

  2. The following process shall be followed while processing the applications:-
  3. The Directorate of Minorities Welfare shall be the nodal Office to receive applications seeking minority status for all types of Educational Institutions like Schools, Arts and Science Colleges, Technical Education Institutions,

Agriculture, Law, Medical Colleges etc;

In order to make the entire process transparent and efficient, a web portal shall be developed for this purpose immediately. All applications should be received and processed in Online mode.

  • All applications must be made Online to the Directorate of Minorities Welfare along with necessary documents.
  1. Upon receipt of application, the Director of Minorities Welfare shall cause basic verification and send the verified applications to concerned Heads of the Departments for further scrutiny within a specified number of days.
  2. The Heads of the Departments shall be within prescribed timelines, scrutinize the applications on priority. They shall verify the eligibility of the applicant institutions for conferment of Minority Status keeping in view the guidelines applicable to such Academic Institutions.
  3. The Head of Department shall upon completion of scrutiny of application forward the same to the Director, Minorities Welfare under intimation to Government. The Additional Chief Secretary, Backward Classes, Most Backward Classes and Minorities Welfare Department shall compile the details regarding applications and keep a track on the progress.
  • Director of Minorities Welfare, upon completion of scrutiny of application place the same before the Empowered Committee for approval.
  • The Empowered Committee shall meet at least once in three months to examine the applications as per the Government guidelines. Empowered Committee will look into procedural aspects. This Committee is also mandated to frame and update the consolidated guidelines based on the State Government Rules / Procedures / Policy on such matters from time to time;
  1. Once the applications are duly approved by the Empowered Committee, the Director of Minorities Welfare shall issue Minority Status Certificate to the Educational Institutions;
  2. The Committee shall consider any case depending upon the Act / Notification/ Court case etc. and accordingly take a decision based on the special circumstances.
  3. Backward Classes, Most Backward Classes and Minorities

Welfare Department in Secretariat and Director of Minorities Welfare, Chepauk, Chennai – 5 is to be appropriately strengthened by providing adequate supporting staff / resources for handling the subject matter of Conferment of Minority Status to Education Institutions.
