Respected Sir/Madam, Vanakkam!

Sub: Reservations in All India Seats and State / Local Domicile Seats in National Law Schools/ University — Non-Implementation of SC/ ST and OBC exact state reservations in the courses offered by the NLUs — Reminder to act:-

Ref: My Letter dated 25.12.2021.

Vide my letter dated 25.12.2021, I had requested all National Law Schools to follow the constitutional mandate of resen^rations and ensure the strict implementation of reservations for OBC, SC & ST students as per the provisions of the relevant State Acts/ Rules/ Notifications/ Orders in all the seats (including the All-India seats and State/ Local Domicile seats) in UG, PG and Diploma courses at National Law Universities.

I am deeply saddened to note that barring two National Law Schools RMLNLU, Lucknow & NUALS Kochi who responded positively claiming that they are implementing exact state reservations in All India Seats and State/ Local Domicile Seats in National Law Schools/ University in the courses offered by them, other NLUs have neither responded nor have taken any steps to implement the Constitutional reservations/ State reservations for SC/ST/OBC’s.

There are also allegations that some of the National Law Universities are not implementing the exact quantum of SC/ST/OBC reservations

granted by the respective state laws. 1 would have hoped that my letter would have at least evoked some consideration of the issue from your end.

At this juncture, I also wish to point out the historic judgment of the

Hon’ble Supreme Court delivered on 07.01.2022 wherein the Honble Apex Court has upheld the validity of 27% reservation for OBCs in the State contributed seats to All India Quota seats which was granted by the Union

Government after a legal battle by the DMK party commencing from the

Madras High Court. I am citing this judgement only to point out that the Hon ‘ble Supreme Court has upheld social justice and social inclusion in medical and dental education and not seeking to apply the quantum of reservation as it differs according to respective state laws where NLU’s has been established.

We cannot wait for someone to go to Court to grant state reservations in NLU’s. Now more than ever there is a need for representation in law schools. The failure to provide exact state SC/ST/OBC reservations in NLUs has deprived a large section of students from SC/ST and Other Backward classes from having an opportunity to obtain legal education from the top Universities and is in violation of Article 15 and Article 46 of the Constitution, and the relevant State reservation Acts/notifications.

Hence, it is my earnest appeal to all of you to implement exact state reservations ‘in All India Seats and State / Local Domicile Seats as per the law applicable in each of your state and which is in force.

I would also like to bring to your kind attention that failure to implement exact quantum of state SC/ST/OBC’s reservations in All India Seats and State / Local Domicile Seats in National Law Schools/ University will ineVitably result in legal consequences.

Therefore, I once again seek your kind attention to this most pressing issue and request you to do the needful to ensure the strict implementation of exact quantum of state reservations for OBC, SC & ST students as per the

provisions of the relevant State Acts/ Rules/ Notifications/ Orders in all the seats (including the All-India seats and State/ Local Domicile seats) in UG, PG and Diploma courses at National Law Universities at least from the 2022-23 academic year and thereafter.
