In Trial Court especially in NDPS Courts the Police Stations are represented by the Women Police Constable who come there to salute the Judge and blink when their cases are called. It has become a matter of routine work that the Women Police Constables representing the case even though they were not part of the investigating team and this hinders the Trial. Police Officers attached to NIB CCB CBCID etc of special wing do not come to Trial Court in full uniform and also do not wear the Cross Belt while giving evidence but come in casual dress and if questioned their appearance in such way the PP will claim that they are exempted from wearing the uniform but they do not know the fact that how a Police Officer should appear in Court while giving evidence as contemplated in the Police Standing Order. I doubt whether the Police Officer themselves know about this standing order. I remember well years ago the Additional Chief Metropolitan (EO-1) who was transferred from Pondicherry declined the PP from examining the Inspector of Police since he did not wear the Cross Belt. It was a habit to the Police Officers not to wear the pea Cap while giving evidence. He pointed out the rule and instructed the PP that all Police Officers should come to Court as prescribed in the MPSO. However almost in all Trial Courts in TN the Police Officers do not wear the Cross Belt while giving evidence but those Police Officers when come to High Court they wear it.

[6/7, 19:15] RUPERT Mhc Advt: I have problem with Trial Court in regard to Sec 313(5) of Cr.P.C. When I raise this issue what I have found that the Trial Court Judges and PPs are really unaware of the newly introduced Section 313(5) Cr.P.C. In Two Courts recently ignored it when I raised this issue and made my submissions about the scheme and scope of it for minimum 15 minutes but the Trial Judge went ahead of their 313 questioning on the next hearing date. The PP is also not aware of 313(5) CrPC Even before the SC Judgment could come on that Section I raised it but the Trial Court ignored it. The Supreme Court Judges J A.S. Oaka and J Rajesh Bindal recently have held that Trial Judges who do not acted upon Sec 313(5) the Judicial Academy should take note of such Trial Court Judges failure which means that they should undergo to refreshers course. I think the Portfolio Judges should scrutinize the violation or else while in Appeal the HC Judges should check whether the Trial Court has invoked Sec 313(5) of Cr.P.C. or not.
