sekarreporter1: In today’s hearing of Ashwini Kumar Upadhyay V Union of India also known as the religious conversion matter, Senior Advocate Mr. P Wilson representing the state of Tamil Nadu argued that the writ petition was politically motivated as petitioner is a BJP spokes person. Petitioner is facing sedition charges has suppressed filing of earlier cases for same prayer which was dismissed as withdrawn. He also submitted that TN state has to be heard as the partitioner has made serious charges against Tamilnadu Government about religious conversions at least at 3 different places in affidavit. He also submitted that the matter pertains to public order which is found in entry I List II and therefore it’s a state subject

Petitioner is facing sedition charges has suppressed filing of earlier cases for same prayer which was dismissed as withdrawn. He also submitted that TN state has to be heard as the partitioner has made serious charges against Tamilnadu Government about religious conversions at least at 3 different places in affidavit. He also submitted that the matter pertains to public order which is found in entry I List II and therefore it’s a state subject. The petitioner is asking a direction against state and Center to frame laws on banning conversion and without hearing state no reliefs .He vehemently argued that all allegations made by the writ petitioner regarding state of Tamil Nadu were blatantly false and that the state legislature is the competent body to decide on such matters and there cannot be any directions against state legislature to frame laws and questioned maintainability of the writ petition itself. He submitted that in Tamilnadu in the year 2002 an Act to ban religious conversions was brought which was later repealed in 2006 by state legislature . He submitted that the state knows what laws are suitable and people are living peacefully in Tamilnadu.
The Bench aftertaking into consideration the arguments made by P.Wilson asked Attorney General to assist the court and also change the cause title of the matter to In Re: Issue of Religious Conversions by deleting the Petitioners name.
The bench permitted govt of Tamilnadu to file its counter and posted the case to 7.2.2023
