We had made exhaustive recommendations on the Bill. However, the Union Government has not adopted the Standing Committees’ recommendations in their entirety in the Mediation Bill, 2023 tabled before Rajyasabha in this session. The bill is likely to be moved in Loksabha on 4.8.2023.

One of the major recommendations made by the Standing Committee to make mediation non-mandatory before initiating litigation has been accepted by the Govt. I see that as a great breakthrough.

However, the Government has rejected many of the other key suggestions of consultees which we had incorporated in our recommendations.

I hope that initial teething problems, if any, will be fine-tuned by amendments as the law is not static!

If this Bill is passed by Loksabha and after assent of Hon’ble President is notified, mediations will be statutorily available.

Advocates & litigants have new avenues of dispute resolution & I appeal to one and all to make good use of this alternative dispute resolution mechanism that will be cheap, quick and effective.

Advocates can also equip themselves to become mediators and participate in this noble calling of settling disputes amicably through mediation.
