The Special Leave Petitions relating to Orders passed in batch of Writ Petitions filed by RSS by the Hon’ble Madras High Court Principal Bench and Hon’ble Madurai Bench of Madras High Court came up for hearing today (03.11.2023) before Hon’ble Supreme Court. Mr. Kapil Sibal, Senior Counsel appeared for the State of Tamil Nadu. When the matter came up for hearing today, Hon’ble Judges asked Mr. Sibal as to how the SLP’s are mainatimable and why not file Intra Court Appeal; to which Mr. Sibal requested some time to verify the Madras High Court Rules relating to the same. Mr. Hasan Mohammed Jinnah, Learned State Public Prosecutor intervened and informed Court that Intra Court Appeal will not lie since there is a specific bar as per Clause 15 of the Madras High Court Letters Patent Appellate & Original Side Rules since it has been filed as Criminal Writ Petition and hence Hon’ble Madras High Court does not entertain Writ Appeal. Hon’ble Judges directed the State to produce details of the Madras High Court roaster and relevant judgments to show the present appeal is maintainable on 06.11.2023.
