[2/24, 15:12] Sekarreporter 1: Today 24.02.2022 Public prosecutor of GT court filed custody petition on behalf of H3 Tondiarpet Police station in Former ADMK Minister Mr.D.Jayakumar 307 IPC case. The said petition was filed before the 15th MM Judge at George Town Court (GT Court). Mr.A.Natarajan Senior advocate (Former State PP) appeared for former minister and vehemently objected the custody petition stating that there is no custody required in this case. Mr.A.Natarajan also relied that citation of Hon’ble high court which states that police can very well interogate inside the prison itself and not all the cases required police custody. After hearing the arguement the learned judge informed that the custody petition can be decided only tomorrow since The Investigation officer of the case should depose before the court with justify grounds for what purpose custody is required in this case. The learned judge also informed that the former minister should also produced before the court tomorrow by 11.30 AM without fail at the time of hearing custody petition. Hence custody petition is adjourned to tomorrow 11.30 AM for arguments.
[2/24, 15:12] Sekarreporter 1: Today 24.02.2022 Former ADMK Minister Mr.D.Jayakumar bail petition in another case were Section 7(1)(a) Criminal Law Amendment Act was included, came up for hearing before the Hon’ble 16th MM Judge at George Town Court (GT Court). Mr.A.Natarajan Senior advocate (Former State PP) appeared for former minister. Today Mr.A.Natarajan argued that the police altered the FIR and included section Section 7(1)(a) Criminal Law Amendment Act only in order to make the offence non-bailable. He argued that Police got no power to register an FIR under section 188 IPC as well as section Section 7(1)(a) Criminal Law Amendment Act as the ruling of hon’ble high court of madras. The alteration report of offence such as Section 7(1)(a) Criminal Law Amendment Act is invalid and has no legal stand. Apart from that he also argued that as per the ruling of hon’ble High court Section 7(1)(a) Criminal Law Amendment Act (CLA Act) is also bailable offence. He argued that section 7(1)(a) of CLA Act is totally irrelevant to this case. Therefore both 188 and 7(1)(1) has to be omitted, other than these sections all other offence are bailable hence bail has to be granted forthwith.
PP formally objected the bail petition and stated police got power to register FIR in 188 and 7(1)(a) relying 1979 GO of tamilnadu. Mr.A.Natarajan replied that both citation given by him is the latest one and it is law of the land so GO cannot overrule Highcourt ruling.
After hearing both side arguments the judge passover the case for passing orders. Today evening orders will be passed.
[2/24, 15:12] Sekarreporter 1: Today 24.02.2022 Former ADMK Minister Mr.D.Jayakumar bail petition in 307 IPC case come up for hearing before the Hon’ble Principal Sessions Judge at Chennai. Mr.A.Natarajan Senior advocate (Former State PP) appeared for former minister. Today before commencing the arguement PUblic Prosecutor informed the court that bail petition is not received by them hence he sought time. Mr.A.Natarajan informed the court that it is usual practise that copy for PP will be filed at the section then only bail petition will be numbered, but PP strangely inform that copies not received only to prolong the bail petition. Inbetween Mr.N R Elango senior Advocate (DMK MP) sought time to file intervening petition. Mr.A.Natarajan requested the court to hear the matter by today afternoon itself. But the Hon’Ble PJ granted one day time to PP and intervenor to file their reply and intervening petition. Mr.A.N requested fhe court to direct the PP to come with counter if any. PP accepted to compete his side argument by tomorrow itself. Hence bail petition in 307 case is adj to tomorrow 25.2.2022.
