We have taken note of the said status report filed by theRegistrar of Anna University and submissions made by the learned Standing Counsel appearing for the Anna University as well as the learned counsel appearing for other side. In order to fill up the posts of 350 plus Assistant Professor in the Anna University constituent colleges immediately notification is required to be issued consisting the aforesaid provisions for giving weightage to the existing incumbents. Such a draft notification shall be prepared and filed before this Court, for which, the learned Standing Counsel seeks only shorter accommodation till Thursday. Pursuant to our order dated 15.09.2023, the Registrar of Anna

University has filed a status report dated 03.10.2023, where inter alia the Registrar has stated the difficulty of the University Administration to regularize the present temporary faculties and also stated as to why the direct recruitment was not undertaken and  why there has been a delay in processing the direct recruitment as well as the present status of the Anna University to fill up the vacancies.

  1. After hearing the learned counsel on either side, as an interim measure, we feel that, if the permanent vacancies in the three categories of Teaching faculty at the Anna University i.e., Assistant Professor, Associate Professor and Professor are filled up by taking immediate steps that will solve the issue, provided while making such measures to fill up the present vacancies especially in the entry level post of Assistant Professor by way of direct recruitment, what kind of advantage shall be given to the present incumbents, who have been appointed few years back and has been working till date as Assistant Professor rendering service to the Universities through its constituent colleges also to be decided.
  2. In this context, it is to be noted that the University syndicate vide its resolution dated 02.09.2023 has found that, as per the AICTE norms, 1158 posts of faculties must be made in the University constituent colleges. Out of which, 835 posts of Assistant Professors, 224 posts of Associate Professors and 99 posts of Professors are to be filled up. However, presently 484 Assistant Professors, 15 Associate Professors and 5 Professors alone are working, which itself is an anomalistic situation, where the constituent colleges of the University 16 in numbers are functioning with only 5 Professors and 15 Associate Professors.
  3. Therefore, urgent steps are to be taken to fill up the vacancies.
  4. The learned Standing Counsel appearing for the Anna University, on instructions, would submit that, the University is ready to file the draft notification inviting applications to fill up the posts of

Assistant Professors by way of direct recruitment, for which there are 351 vacancies as of now are available. The University counsel has also submitted that the present incumbents, who are temporarily working for several years also have to undergo the direct recruitment process by competing with the open market candidates. However, in order to give advantage to these incumbents by taking into account the service they rendered all these years at the Anna University constituent colleges, weightage marks would be given to these incumbents. Therefore, what kind of weightage should be given to these incumbents would also be decided and be added in the very notification itself.

  1. That apart, the learned Standing Counsel appearing for the Anna University would submit that, the notification will also carry the instructions to follow the 69% communal reservation being followed in the State of Tamil Nadu and fitment will be made in the 200 point roster.
