When the matter was taken up for hearing on the earlier occasion on 26.08.2022, this Court has recorded that none appeared for the petitioners in both the writ petitions. Today, learned counsel for the petitioner in W.P.No.16704 of 2022 present.

According to the learned Additional Advocate General appearing for the respondents, the petitioners have challenged the impugned proceedings dated 23.06.2022 passed by the Commissioner of School Education-cum-the Director of Elementary Education, Chennai and the Madurai Bench of this Court by an order dated 01.07.2022 has granted interim stay of the aforesaid impugned order.

Subsequently, the said impugned proceedings issued by the Commissioner of School Education-cum-the Director of Elementary Education, Chennai, has been revised by the Commissioner of      School Education, Chennai by its Proceedings in Na.Ka.No.34087/C2/E2/2022, dated 01.07.2022. Therefore, according to them, the petitioners have not taken steps to challenge the said proceedings dated 01.07.2022. The impugned proceedings has subsequently considered and passed the order only the qualified teachers have to be appointed viz., teachers who have passed TET examination alone eligible for temporary appointment in the Schools.

 

  1. Insofar as the temporary appointment to the post of Secondary Grade Teachers and BT Assistants for the Elementary Schools and Middle Schools are concerned, the District Educational Officer is the competent authority to approve the temporarily appointed teachers in the said post. Insofar as the temporary appointment to the post of PG Assistants for Higher Secondary School are concerned, the Chief Educational Officer is the competent authority to approve the temporarily appointed teachers in the said post.

The learned Additional Advocate General appearing for the respondents further submitted that the writ petition in W.P.(MD).No.13751 of 2022 filed by the association is not maintainable in the light of the order passed by this Court in Tamil Nadu Survey Officers Union vs. Government of Tamil Nadu and others (W.P.No.10465 of 2022 dated 28.04.2022). He further submitted that the petitioners have not challenged revised proceedings dated 01.07.2022.

 

6.Mr.R.Neelakandan, learned Addition Advocate General appearing for the respondents would inform before this Court that the Teachers Recruitment Board has taken all the efforts for finalising the provisional selection list for appointment of P.G. Assistant, Secondary Grade Teacher and BT Assistant and the same will be communicated to the users department viz., the Education Department at an earliest. He further stated that the Teachers Recruitment Board has called for the candidates to appear for certificate verification which is scheduled to be commenced from 02.09.2022, 03.09.2022 and 04.09.2022 for the post of P.G. Assistant. He assured that the entire selection process will be concluded as expeditiously as possible.

In the light of the above submissions and considering the revised proceedings dated 01.07.2022 issued by the Commissioner of School Education, this Court permits the respondents to fill up the vacancies and permits to proceed with the temporary appointment of teachers in respect of Elementary Schools, Middle Schools and Higher Secondary Schools, till the regular appointments have been made by the Teachers Recruitment Board. As per the revised circular, the respondents are directed to appoint the qualified teachers viz., the candidates who have passed TET Examination alone is eligible for temporary appointment to the aforesaid posts.

 

  1. In respect of other issues are concerned, this Court will be decided at the time of final disposal of the writ petitions along with other connected writ petitions.

 

9.In the light of the above observation, the interim stay granted by the Madurai Bench of this Court in W.M.P.(MD).No.9760 of 2022 in W.P.(MD).No.13751 of 2022, dated 01.07.2022 is vacated.

Post these matters along with connected writ petition after eight weeks for final disposal.
