The Honourable Mr Justice D.BHARATHA CHAKRAVARTHY passed an order today at 2.15 p.m in WA 3328/2023 filed by CHENNAI HIRANANDANI RESIDENTS WELFARE ASSOCIATION against
THE SECRETARY AND 2 OTHERS.

A Division Bench of Madras High court quashed the approval granted by DTCP to the property developer Hiranandani for modifying the original sanctioned plan for their project called House of Hiranandani at Egattur, Navalur.
The developer had obtained from DTCP, in 2020, approval for modifying the original plan sanctioned in 2012 by CMDA. The modified plan was to build two high rise towers of saleable flats in the location earmarked for locating a Club House and also to build villas in the location earmarked for flats.
The Chennai Hiranandani Residents Welfare Association filed a Writ Petition to quash the approval on the ground that it was obtained without getting the consent of 2/3rds of the purchasers and that it amounted to a fraud on the purchasers depriving them of the promised Club House.
The Learned Single Judge had dismissed the Writ Petition.
In the appeal filed by the Association, after hearing the arguments of the Senior Advocate Mr.K.Ravi, the Division Bench of the Hon’ble Chief Justice Gangapurwala and the Hon’ble Justice Bharata Chakravarthi today set aside the judgment of the Learned Single Judge and quashed the approval granted by DTCP.
