i periyasamy case Having noticed the aforesaid factors, prima facie, this Court is of the considered view that it would be failing in its constitutional duty if it does not invoke its suo motu powers under Sections 397 and 401 Cr.P.C and Article 227 of the Constitution of India against the order of the Special Court dated 17.03.2023 discharging A3 from C.C.No.13 of 2019.
