O R D E R

In terms of order dated 18.11.2021, the appropriate authority was directed to consider the representation
submitted by the writ petitioners.
From the counter affidavit filed by respondent No.1, it is noticed that representation has been finally
decided on 03.12.2021. If the petitioners are aggrieved by that decision, they are free to challenge the same by
amending the present writ petition, if so advised.
The petitioners are given three weeks’ time to take out formal application for amendment of writ petition,
including to seek further reliefs, as may be necessary.
An advance copy of the application be served on the standing counsel for the respondents who in turn may file response to the application before the next date of
hearing.
List the matters on 21.01.2022.

Although the petitioners are questioning the ratio prescribed in the scheme formulated by respondent No.1 – CBSE which has received approval of this Court, as similar argument for re-consideration thereof has been rejected in the past including in Writ Petition No. 522/2021 and connected cases vide order dated 22.06.2021, we dispose of this writ petition with limited indulgence
to the petitioners to pursue their representation
submitted to the Chairman, CBSE (Annexure P/3), which be
decided on its own merits in accordance with the
finalized scheme and to ensure that their claim covered under the scheme is appropriately dealt with to the extent permissible. All contentions in that regard are
left open.
In other words, it will not be open to the
petitioners to challenge the scheme or the ratio for evaluation of marks prescribed therein. For, that has already been upheld and received seal of approval of this Court in the previous orders.
The representation be decided expeditiously
preferably within three weeks from the date of receipt of
the copy of this order.
This petition and pending applications, if any, stand disposed of accordingly.

We dispose of the writ petition with a direction to the Respondent No.1-CBSE to decide the representation submitted by the petitioners addressed to the Chairman, CBSE (Annexure P/7) within three weeks from the date of receipt of the copy of this order on the same terms as
noted hereinbefore.
It will be open to the petitioners to forward a copy of this petition along with annexures through their advocate addressed to the Chairman, CBSE with request to
treat it as their representation.
This petition and pending applications, if any, stand disposed of accordingly.

We dispose of this writ petition on the same terms as
other writ petitions decided by this common order.
The petitioners to serve a copy of the writ petition on the standing counsel for the respondent – CBSE by tomorrow, i.e., 07.12.2021, so that it can be forwarded to the Chairman, CBSE for being considered as their representation and to be decided within three weeks from the date of receipt thereof. The representation be

decided on the same terms as indicated earlier.
