Court Hall 5, item 2 a case filed by Senior Counsel G. Rajagopalan regarding the over night construction of MGM health care in St. Marrys road. The MGM health care is constructing a 10 store building in alwarpet St. Marrys road, the construction work is being done day and night. The major allegations is that the construction is happening during night time by piling method. Senior counsel gave a representation to take action against MGM health care for constructing beyond business hours especially during night hours. The Writ Petition came before Justice R. Subramaniam and Justice R. Sakthivel for admission the division bench gave a interim injunction restraining the MGM health care not to construct between 10PM and 6 AM, further directed the pollution control board to file a report on ambient air quality and measure sound level of the construction. The bench further directed the government to file a report whether proper permission for commerical construction is permitted in the residential area of St. Marrys road and posted on 07.02.2024.
