This Writ Petition has been filed seeking to provide incentive marks to the petitioners for the period working in COVID duty. It is the contention of the petitioners that for more than 300 days they worked during Covid. The Apex Court Suo Motu in W.P.No.3 of 2021 in para 72 has held that there must be effective policy to ensure that the nation truly acknowledges their effort and creates incentives for them and it will be remedied soon by the Central and State Governments through introduction of appropriate guidelines and measures.

Based on the above recommendation, the Central Government also passed a notification vile file No.Z.20015/43/2021-ME-1, dated 03.05.2021 and in clause 17 of the said notification has held that the Central Government recommends to State/UT Governments to consider giving preference in regular Government appointments of Health professionals through the respective
Public Service Commission/ other recruitment bodies for those Health Professional under this special scheme, who complete a minimum of 100 days of Covid related duty. Based on the above said notification, Andhrapradesh Government issued a Notification No.04 of 2022 wherein weightage has been given to the effect 5 marks per 6 months of service for COVID 19 duties.

3. The grievance of the petitioners is that Medical Services Recruitment Board has conduced examination. However, no scheme whatsoever has been framed and results have also been published and if recruitment process is completed, the petitioners’ legitimate expectation will be affected. Hence, seeks stay of further proceedings.
4. Mr.S.Prabhakaran, learned Government Advocate takes notice for the respondents 1 to 4 and Mr.M.Loganathan, learned counsel takes notice for the fifth respondent and seeks to file counter.
5. Having regard to the fact that based on the above notification of the
Central Government, no scheme has been put in place by the State of Tamilnadu and since examination has already been conducted and results has also been published, there shall be an Order of interim stay for issuing appointment Order.
6. Post on 11.08.2023 for filing counter by the respondents.
